Boris Epshteyn said that no one can state for certain that it would be unconstitutional for former President Donald Trump to be reinstated to the presidency since the U.S. Constitution does not prohibit reinstatement and the issue has never been ruled upon.
During an interview with Dr. Gina Loudon on Real America's Voice, Epshteyn, a former Trump 2020 strategic advisor, predicted that the matter will land in the nation's high court.
Epshteyn said that "the interplay of the 10th Amendment" to the U.S. Constitution, the 12th Amendment and Article II, "would suggest that states do have a right to decertify. And from then, it's an open question what happens next."
He said that after information becomes available from state audits, "decertification should happen because that's the correct step from the states. And from then on in terms of deciding what to do about the federal election, well, there's gonna be an open question," he noted, remarking that he believes that the matter will go before the Supreme Court.
There is a difference between “does not prohibit” and actually having a Constitutional process to effect the reinstatement.
Votes were certified, approved, and accepted. Case closed. There is no reversal, no decertification.
Epshteyn won’t kill himself.

The President is elected via the Electoral College. Each state is free to choose its delegates, and each delegate free to pick their candidate (depending on the state laws I guess). That 4-5 states chose to select the delegates based on a fraudulent election is “their business” in that they can choose their delegates any way that they want to.
Drop this one in the bin alongside “Obama Birth Certificate.”
But the electoral college voted for Chomo Joe. Does it matter? And with Trump appointing 3 Trump hating Bush loyalists to SCOTUS there is no way they will get rid of Biden.
Exactly. I understand the appeal of the “reinstatement” fantasy, but it just ain’t happening. By all means, audit and expose the fraud of 2020, but I don’t know what sort of drugs one has to be using to think that there’s some entity out there with the ability and *willingness* to nullify Dementia Joe’s election. Hell, SCOTUS etc. wouldn’t touch the thing last Nov/Dec *before* anything was finalized. It’s delusional to think they’ll take it upon themselves to nullify it all after the fact.
In my view, if the Constitution does not prohibit a matter or is silent on an issue, then it is open to argument in the court system.
If the states determine there was vote chicanery involved to the point of fraud, it seems to me it could be brought up.

I agree with you, I am all for these vote audits going on, the massive cheating has to be exposed, regardless of how it’s reported on in the media...
But there is no way Trump is going become POTUS again, unless he wins in 2024...
The best we can hope for is to expose the cheating and to the extent possible get it eliminated.
But I wish people like Epshteyn would stop with saying otherwise...

This whole idea is a pipe dream, a complete fantasy. I don’t know what’s less probable, this or the coming (any day now!) indictments from the phantom Mr. Durham.
It just makes conservatives and patriots look like a bunch of loonies.

They probably do, but they would only be decertifying electors who have already voted in an electoral college vote that has also already been certified. The states decertifying their elections won’t do anything to decertify the electoral college vote, nor would it remove the sitting president, so this is just fantasy.

Regardless of how it gets there, if it arrives at the current SCOTUS, it’ll be DOA.
I know it will never EVER happen BUT:
IF, based on the results of audits that confirm that Biden won as a result of massive fraud, and
IF, enough states voted to rescind their certification, whether Constitutional or not, and
IF, Biden and Harris possessed even a tiny speck of integrity,
THEY would resign immediately for the good of the country because they would be proven to be criminals not worthy of their offices, and the Democrat party would be proven to be a criminal organization out to circumvent and destroy the Constitution.
But it will NEVER happen because Democrats lust for absolute power and they do not care how they get it.
The appointment of Electors are not federal elections.
