On Monday, the Supreme Court unanimously rejected an illegal immigrant’s attempt to twist immigration law and create a loophole that would allow thousands of illegal immigrants to become lawful permanent residents. Democratic senators and attorneys general advocated for this loophole, but a liberal justice wrote the opinion for a unanimous Court.
“Petitioner Jose Santos Sanchez entered this country unlawfully from El Salvador. Years later, because of unsafe living conditions in that country, the Government granted him Temporary Protected Status (TPS), entitling him to stay and work in the United States for as long as those conditions persist. Sanchez now wishes to become a lawful permanent resident (LPR) of the United States. The question here is whether the conferral of TPS enables him to obtain LPR status despite his unlawful entry. We hold that it does not,” Associate Justice Elena Kagan, an Obama appointee, wrote in the opinion.
In Sanchez v. Mayorkas, Kagan noted that U.S. immigration law, “applied according to its plain terms, prevents Sanchez from becoming an LPR. There is no dispute that Sanchez ‘entered the United States in the late 1990s unlawfully, without inspection.'”
Yet Democrats and immigration activists twist the law to argue that if an illegal immigrant obtains temporary protected status due to violence or bad conditions in his or her home country, he or she can be considered “admitted” for the purposes of obtaining LPR status...

Nah! Like the other freeper said it’s a warning shot across the bow don’t mess with packing the supreme court! They’ll get back in line as soon as Biden and the Senate declare no court packing.
Sounds impressive - but, it's useless.
The Democrats and the GOP will just give this guy permanent TPS.
Eventually, he will get Amnesty, then citizenship, then vote Democrat forever.
Your post offers the only perspective that makes sense to me. I wonder if this is the real story.
It’s fine and dandy to dilute the power of the average American but not the elite, I guess.
May I make a slight correction to your otherwise great post?
“Perhaps all 9 have realized that the politization of the court has went too far...”
This should be written as either *went too far* or *has gone too far*.
I realize this may have been a typo, so I hope that my comment is taken in friendship.
RACISM!/S
What metrics are used to define bad conditions in one’s home country?
It is entirely subjective and therefore easily politicized.
That,to me, is worth a legal challenge
Import the Third World, become the Third World. Our education system quit teaching how to be Americans decades ago. So you can’t really expect the immigrants to fully catch on. Some may, but it’s a heavy lift, most won’t.
An offer they couldn’t refuse?
9-0 opinions (X3) in three weeks. That’s a wrap. 🤔
Wouldn’t surprise me if Judge Thomas had sent a copy of ‘Field of Blood’ to each Judge which describes how DC spiraled out of control in the 1840s/1850s. It’s great reference material to the era, and would probably scare a lot of politicians over the atmosphere creating the Civil War.
At first I thought the Supreme Court was sending a message, but that might not be the case. 9-0 cases are by far the majority (see link below).
Kagen is not Sotomayer, but yeah, pigs are flying!!
The Hews I knew in college were mostly of the type who loved Clams Casino and pork ribs . . . they just felt bad about it.
If Congress passes a law modifying TPS as a pathway to citizenship, then SCOTUS will give Xiden and Robotox the 5-4 insurance to uphold it, with Roberts writing that future decision.
So somehow Roberts has persuaded the Court that while he falsely believes healthcare is a right, US citizenship is not, or at least not without following the current legislative pathways.
Or more likely, he knows the short route to real trouble would be if SCOTUS overturned Article I, Section 8 and gosh the 14th Amendment as well. That would be black-robe insurrection.
I’ll be the cynic here. They’re trying to show us how reasonable they are, after refusing to hear any of the cases brought before them, about the fraudulent election. But, even as a cynic, I hope this is a signal that they’re coming to their senses, or at least reading the mood of the country. But they know when the audit results come in, they’ll have to take those resulting cases up. How can they do less than overturn the election? They’re cowards. They’re going to decide conservatively on every single case that comes to them, so they can decide AGAINST the call to overturn the election, while claiming to be fair. I hope I’m wrong. I pray I’m wrong.
Someone just cashed the IOU from not taking any election fraud cases.
Thank you for that. The agreement ratio among the justices should put a dent in the reconfiguration efforts to “pack the court”, by the Marxist wave.
It should mute the effort.
Is RBG still dead?
You just elucidated what I was trying to formulate.
indeed she is!
You never know when a lib can become enlightened and realize what the hell is happening to this once great country. After all, they have families here too.
