As the Centers for Disease Control and Prevention continues to relax safety measures for people who are fully vaccinated against the coronavirus and the country begins to reopen, many employers, businesses, families and friend groups are finding themselves in the at-times uncomfortable position of having to ask about others’ vaccination statuses.
Some Americans, including Rep. Marjorie Taylor Greene (R-Ga.), are balking at such questions and are claiming that asking about or requiring proof of vaccination is a violation of the HIPAA federal privacy law.
“Vax records, along with ALL medical records are private due to HIPPA rights,” Greene recently tweeted, misspelling the law’s acronym.
In the caption of an Instagram post that was flagged for containing false information, another person wrote, “If anyone asks for your vax status, tell them they have no right to know.”
That’s a common misconception but is “simply untrue,” said Robert Gatter, a professor with the Center for Health Law Studies at St. Louis University School of Law. Citing HIPAA as a reason to not disclose vaccination status is often a “knee-jerk reaction” that “quickly gets turned into a statement that sounds like law,” Gatter said. People sometimes say, “‘But I have a right not to be asked that question,’” he continued, “and it’s just not the case.”

The problem was she named both me and the company I worked for at the time for a HIPAA violation by name in her email that went out to many people, very publicly and threatened not only a lawsuit against me personally but also the company I worked for that was subject to HIPAA as a third party health insurance administrator. Both my internal HIPAA compliance folks and our outside compliance company knew she had no claim and that she was basically bat sh!t crazy, but they had to do what they had to do, basic due diligence in order to protect both me and my company from any potential litigation and I couldn’t blame them for doing that.
Huh? You've been telling everyone in this thread what HIPAA is, got pushback from myself and some others, and then directed me to that thread in response as if it proved you were correct. Now, you say "it's not about HIPAA". Well, it sure as hell seemed to be about HIPAA when you were arguing it in here. Did your big team of lawyers all get disbarred or something?
So companies that try this are going to open themselves up to plethora that could last a very long time. Thus, putting them out of business.

What fantasy is that? Non health related companies are stepping into the role of requiring health information from employees, then dictating behavior based on that information, and finally they aren’t only sharing that information but even going so far as to publish that information.

I’m gonna respectfully disagree with the government doesn’t have a data base. They do. It’s called VAMS - vaccine admin mgmt system- and its managed by the CDC. Every state health dept reports covid vaccines in this system. Every healthcare system, pharmacy etc is reporting the personal info for those taking the covid vaccine. I know bc I’ve used it. Look it up. They are keeping track. It’s scary.
States can record identifying information. HOWEVER, it is illegal for them to pass that identifying information on to the Federal Government.
Most of the State databases have opt-out procedures.
There was an article about this “problem” in the WSJ not to long ago, with the implication that the “EVVVVIIIILLLLL” Republicans were blocking this “commonsense” legislation.
Apparently only 9 States are even using VAMS:
If that wink means forging a CDC vaccination card that’s a felony no different than forging a social security card. Both are protected federal documents under numerous USC codes. The feds are ready and willing to start prosecuting those that do. Plus if fake cards become rampant it will virtually guarantee a block chain secured digital version is created that is impossible to forge and once that QR code and database is up and running the sky is the limit to how it will be used.
Relevant laws, that code is a ten year felony with loss of voting rights and firearms for life.

You vastly overestimate both the competence and the resolve of the federal government.
I am well aware of 18 USC 1017, but I frankly don’t care about it. I haven’t bothered to Shepardize the Code section, but it really doesn’t matter.
Civil disobedience in regard to tyrants is necessary to secure liberty.
The federal government will make a few very public and very severe cases as examples. Just like they have Jan 6th trespassers in solitary confinement with no bail for what should be a misdemeanor charge. By all means be the one the feds decide to make their public examples of. My point stands of fake cards become an issue it will guarantee that they move to digital block chain secured versions and once that form of national id is in place it will never go away. Don’t take the vax that’s fine but be ready to deal with the outcome of that choice. Frauding the government only messes it up for everyone else in the long run.

I hate to break it to you, but the federal government doesn’t have the means or ability to go after everyone.
It is incredibly difficult to get the federal government to prosecute cases generally. Contrary to what most people think, the federal government prosecutes very few cases and it is like pulling teeth to get them to move forward on things.
If you are printing off hundreds of cards and selling them at bars they might take notice. The average Joe who makes his/her own card?
1. There isn’t a way to actually verify. The vast majority of places aren’t checking anyway. Karen at the Walmart door, or Karen in the HR office is not going to call up and see if your card is real.
2. THERE ISN’T A FEDERAL DATABASE, AND IMPLEMENTING ONE IS LIKELY ILLEGAL. (Thank you Ron Paul.)
3. Most State databases have opt-out procedures.
4. Because of virtue signaling Karen’s such as yourself (yes, you are a big advocate of forcing the vaccine on people) there are thousands of lot numbers and dates that correspond with actual vaccine administrations out there. This makes faking the card much easier.
5. There is zero public will for mandates, except for the most extreme Karen class, yourself, academia and some woke HR in retard corporations.
