It is not a HIPAA violation to ask if someone is vaccinated

As more people get their COVID-19 shots, many are finding themselves in a position of having to ask others about their vaccination status.

Some are wondering if this violates the Health Insurance Portability and Accountability Act, or HIPAA.

Ellen Cihak has not been asked if she is vaccinated against the coronavirus. She also hasn't been asked to show proof in Appleton stores.

"I would like to see that happen. I don't know if it's legal to do that," said Cihak.

Like many others, Cihak doesn't know if the question violates HIPAA.

John Fisher is a health care attorney who specializes in health care compliance and ethics. He says although the vaccine status questions might be uncomfortable, it does not violate HIPAA.

Well, if someone asks you if you have been vaccinated, you could always ask them if they still have VD.

I have already decided, the first person who asks if I have been vaccinated, I am going to reply by asking, "Do you still like anal sex?"

I mean, if you are going to ask personal questions about me, it is only fair I ask personal questions about you. Right? LOL!

Fisher says the law does not apply to private individuals, meaning businesses and employers can ask for vaccination status and proof of vaccination.

Well then what the hell is HIPPA for? I thought is was to protect the health information privacy for the individual.

Here are some possible responses to whether you are vaccinated:

"What do you think?"

"That is none of your business."

"Are you vaccinated too?"

You also could merely point to the small magnet glued to your upper arm.

My best friend is an attorney. She has told me numerous times that if you decline a vaccine for yourself or your child its illegal to ask you why. As far as asking if you have been vaccinated IDK.

Ask them about their HIV (AIDS) status and prove they are taking their medications for it.

That does illustrate the problem with these potential government "vaccine passports" and encouraging the vaccinated public to behave like informants. These type of things never end well.
