Even if he did, that liability would be only on paper. The state indemnifies the governor.
That said, the named loser here is a matter of using correct legal form. The governor is the state actor who made the rule, so the governor is named defendant. Governor is acting in government capacity, so government pays.
Lawyers never work for free. That's why they call the work "pro bono."
