If the mother or baby-daddy is not a US citizen, and the child is born on foreign soil, where comes this birthright citizenship for the foreign born child of a foreigner in a same sex couple?

Yes, as in Obama. IMHO he was not a natural born citizen as he had at least dual citizenship. Yes I believe this also applies to Ted.
So in the case of my daughter that has dual citizenship, she is not natural born presidential eligible, IMHO.

I realize that in this day and age, nothing matters, but is does the agency have the ability to grant citizenship?
The USCIS (US Citizenship and Immigration Services) is under the DOS. So yes the state department is responsible.
