The big surprise of the day, however, was the state’s sudden claim that they had discovered “new evidence” that justified re-calling state expert witness Dr. Martin Tobin, pulmonologist, to the witness stand to rebut some of yesterday’s testimony by defense expert Dr. David Fowler, a forensic pathologist.
The “new evidence” was purportedly just-discovered data on Floyd’s blood oxygen levels when at the Hennepin County Medical Center.
The state wished to have Dr. Tobin testify about that data to rebut suggestions by Dr. Fowler that given the proximity of Floyd’s face to the exhaust of squad car 320, it was possible that Floyd’s carbon monoxide blood concentration could have been as high as 18%–a level Fowler testified was sufficient to be dangerous to Floyd, and a contributing cause to Floyd’s death, given Floyd’s fragile physiology.

Obviously, this demand for rebuttal by the state, particular on this blood data “discovered” just after Fowler’s testimony ended yesterday afternoon, and with notice provided to the defense only about 5 o’clock in the evening, was about as late in the course of the trial as could be imagined.

First, the state claimed that the Hennepin County Medical Examiner, Dr. Thomas Baker, after hearing Fowler’s testimony yesterday on the carbon dioxide issue, had somehow dug into the hospital’s records and found that Floyd’s blood concentration of CO had, in fact, been measured at the time—but had never been previously produced when the parties had subpoenaed Floyd’s medical records.
The state now wanted these data to be shared with the jury and explained by Dr. Tobin, to rebut Fowler’s claim that Floyd’s CO concentration could have been as high as 18%.

With oxygen levels at 98%, how can they argue he was asphyxiated?
It will not matter. I suspect less than a day for the jury to return a guilty verdict.

I said as a joke that the foreman asked the judge on the first day "Can we give our verdict of guilty now, your honor? All of us agree already."
Judge (chuckling softly): "No, no. We have to have the opening statements, presentation of evidence, testimony and closing arguments first and then you will be asked for a verdict vote."
If they had solid evidence of strangulation or neck compression, they could do it that way. But, they don’t. Instead, their argument was essentially that the weight of one of Chauvin’s knees made it impossible for Floyd to breathe (which is nuts, of courts).
Tobin’s testimony has really undercut the state’s entire case, something that the media seems to be ignoring in this evening’s broadcasts.
So a Tesla squad car would have meant Floyd would still be alive and now suing the police and the state for his suffering in being arrested?
They were giving him oxygen in the ambulance via ambu bag. This is after he went 11 minutes with only two puffs of air.
That goofy looking overage hippy “doctor” in pictures I saw with caption “knee caused cutoff of breathing that killed Floyd” or something like that looked like he was found in a rehab place.
So they could decide Floyd had no oxygen to breathe to stay alive but had enough to blurt out his crybaby “I can’t breathe” mantra and his spite against the cops to rile up his posse the great unwashed street crowd jeering the police behind them.
Sort of multitasking breathing/non breathing. Like a stage ventriloquist. Pretty clever for a very low IQ felon.

I think Fowler deliberately exaggerated the exhaust numbers and his gut told him that they had the numbers. And sure enough...Baker fessed up.

Not disagreeing with your statement, but asking were did you get
that info? Are you saying he wasn’t breathing while being held down?
Ummmm... Think about that a minute. 100% oxygenation is when every red blood cell is fully oxygenated. 98% oxygenation means that 98/100 red blood cells is fully oxygenated. The test discriminates between CO and CO2.
Essentially, your post is saying tha the test cannot see the difference between CO and CO2.
Ocygenation is a measure of the bloods reaction to “active” (for lack of a better word) oxygen in the blood. CO is not “active”.

I went through the body cam images and timed it. 11 minutes passed from the point at which he went unresponsive to the point at which he was connected to oxygen inside the ambulance and was being given adequate respirations in conjunction with high quality CPR via a Lucas device. Inside that 11 minutes, he received two puffs of air from the ambu bag (not connected to O2 yet) at around 9.5-10 minutes IIRC. I think the CPR was pretty poor and was initiated too late to be of any use anyways.
His blood was being oxygenated during the code/cpr but it went about 11 minutes without O2 prior to the initiation of high quality CPR and ventilations with supplemental O2.

If the metric was pulse ox, you are correct. It probably was.
*IF* his pulse ox was 98%, then his breathing was NOT impaired, period.
I consider myself corrected. CO poisoning would have lowered his pulse ox.
How was this known? WHAT detected this? Is this real, or are you guessing? Truly just asking.
I don’t think it was the knee. I had thought that he had a heart attack but it sure does look like he swallowed his dope to keep from getting busted with it. If he knew he was about to OD in the back of that police car, he probably would have freaked out like he did and would have done everything in his power to be outside of the car in sight of everyone when the fentanyl started doing it’s thing so they could initiate CPR and narcan hopefully. The freakout seems like it could have been a ploy.
