House and Senate Democrats are poised to introduce legislation to expand the number of justices on the Supreme Court so President Biden can add several of his own picks -- a practice known as court-packing -- but the late liberal icon Justice Ruth Bader Ginsburg once firmly came out against the idea.
In a 2019 interview with NPR, Ginsburg addressed the idea that has gained momentum among Democrats in recent years.
"I have heard that there are some people on the Democratic side who would like to increase the number of judges," Ginsburg said. "I think that was a bad idea when President Franklin Delano Roosevelt tried to pack the court."

Ginsburg did monumental harm to America. Quoting her dead rants will do no good. It is up to the Republican core decent remnant in the Senate. It will be up to leaders like Senators Paul, Cotton and Kennedy to muster forty to forty five patriotic Senators and fillibuster extensively and creatively until the next election.

What would solve this question for all time is to pass an amendment that provides some sort of formula that will indicate when new justices need to be appointed and that formula should be based upon case load and turn around time for decisions. these are easily observable factors in the court’s business. More turn around time means that the court has too much business to attend to and needs additional justices to assist. Likewise, the number of justices could be reduced using the same formula. They should also mandate a retirement age, as well- 75-80 seems logical to me at this point but that can be changed depending on the average life expectancy at a given period.
The point here is- the court should never be used in a political manner the way it is being used at this time. By having such amendment made to the constitution, you prevent the court packing schemes and keep the balance of power where it should be.
We need to honor her wishes right?
