Biden Gun Speech Filled With Falsehoods

President Joe Biden made numerous false and misleading statements while unveiling a package of gun-control actions on Thursday.

Biden falsely described how federal firearm laws work as he called for Congress to amend those laws. He pushed the Senate to pass H.R. 8, which would ban private gun sales unless done through a licensed dealer, by claiming there is a special exemption for sales made at gun shows.

"Most people don't know, you walk into a store and you buy a gun you have a background check," Biden said in his speech at the White House. "But you go to a gun show, you can buy whatever you want and no background check."

Most people do not know what the president said because it is not true. Federal law does not regulate gun sales based on where they occur. Instead, it regulates them based on who is involved in the sale. If a licensed gun dealer is selling a gun to a private citizen, the sale must go through a background check. Licensed dealers can and do sell guns at gun shows.

When a private citizen sells his own used firearms to another private citizen inside their own state, federal law does not require a background check to be performed. Private citizens do often sell guns at gun shows, but such sales can be conducted anywhere else as well. Some states go beyond federal law and require all gun sales or even transfers between private citizens to go through a licensed dealer, as H.R. 8 would require.

Biden also falsely claimed the gun industry is uniquely protected from all liability while advocating for the repeal of the Protection of Lawful Commerce in Arms Act.

"People don't realize the only industry in America, a billion-dollar industry, that can't be sued, that are exempt from being sued, are gun manufacturers," Biden said. "This is the only outfit that is exempt from being sued."

That claim is also false. Gun manufacturers can be sued and sometimes are sued over claims of negligence. Remington settled a lawsuit over an alleged design flaw with the trigger on its popular Model 700 rifle, and Sig Sauer has been sued multiple times over an alleged safety defect with its P320 handgun. The Protection of Lawful Commerce in Arms Act, which Biden hopes to repeal, provides immunity to the industry over lawsuits stemming from the criminal misuse of guns by third parties.

Even the limited immunity granted to the gun industry is not unique. Numerous other industries benefit from protections against lawsuits that do not implicate willful misconduct on the part of the company. Pharmaceutical companies developing COVID-19 vaccines have immunity from lawsuits over side-effects caused by the life-saving drugs under the 2005 Public Readiness and Emergency Preparedness Act. The same immunity extends to employers who require vaccinations for employment, according to CNBC.

Biden called on the Senate to pass gun-control legislation that has been approved by the Democratic House. He argued on behalf of H.R. 1446, which would extend the amount of time the FBI can delay a gun sale, with more misleading information. Biden said the existing three-day limit for conducting a background check allowed Dylann Roof to carry out the 2015 Charleston church shooting.

"What happened is someone was allowed to get the gun used to kill those innocent people at a church service," Biden said. "If the FBI didn't complete the background check within three days. There was a process. If it wasn't done in three days, according to the Charleston loophole, you get to buy the gun."

While the shooter in the Charleston case did get his gun after a three-day delay, extending the delay period would not have changed the outcome in that case. The shooting happened two months after the purchase and the FBI did not find the records that should have prohibited him from buying a gun. Then-FBI director James Comey said the records were not found because of a mistake made by the FBI when reviewing the shooter's criminal records.

"The alleged killer of so many innocent people at the Emanuel AME church, should not have been allowed to purchase the gun he allegedly used that evening," Comey said in a 2015 statement. "We are all sick that this has happened. We wish we could turn back time, because from this vantage point everything seems obvious, but we can’t."

The White House did not respond to a request for comment on the false and misleading statements made by Biden during his speech. At a press briefing following Biden's comments, White House press secretary Jen Psaki clarified his remarks on background checks at gun shows.

"No it's not his belief," Psaki told Real Clear Politics reporter Philip Wegmann when asked if Biden thought there was a special exemption in federal law for background checks. "He believes that background checks should be universal."

Stephen Gutowski wasn’t quite a NeverTrumper the last four years....but he was close. Maybe if he wasn’t such a nattering nabob of negativity during Trump’s tenure, Joe Biden’s gun control measures would have remained hypothetical.

While President Biden said several false statements, lets not get suckered into accepting his premise.

Background checks do not make us safer.

Most of the guns in the country (about 450 million) are unregistered and untraceable.

Background checks are simply a devise to move toward gun registration.

A much safer system would be a list of people who are forbidden from owning guns. It should be available to the public, with provisions to challenge inclusion, and a methods for being removed from the list for good behavior.

Background checks imply you must prove you are allowed to own a gun.

A list of prohibited people implies due process must be conducted to restrict your right to own a gun.

It is a large difference.

I rarely, if ever, hear an argument that trumps all of these lies and reasons for gun laws. I have one and it leads to one universal gun law. It is quite simple. If someone is convicted of a crime and is in prison, then he or she should not be allowed to possess any weapon in prison. Yeah, I believe that law is on the books. Once released from prison it would be assumed that the individual did his time and has paid his debt to society. With that debt paid, he should have all of his rights fully restored so he can go about being a productive member of society. I will go as far to say he shouldn't have a prison record following him around when getting a job or any other legal activity. We should give people second chances. Not doing so makes it much more likely that he will return to a life of crime.

This approach negates the primary need for background checks. Granted there will be some ex-cons that return to a life of crime, but most of which will never use a weapon in a commission of a crime. Those that would return to a life of crime and use weapons are the type that would avoid a background check anyway. Solution: Catch them and send them to prison again. But allow those that want to be productive members of society to do the things that productive members of society do.

Now let's take on the idea that someone shouldn't own a weapon because they have a mental illness. There are lots of people with mental illness, and quite a few that own weapons. They have committed no crime, but would have a right removed under leftist thinking. They may avoid treatment because they do not want to lose a right. This, I place in the category of punishing someone before they committed a crime. That is a slippery slope. What's next, categorizing people by their thoughts, perhaps political thoughts? Perhaps their religion? Military service? (Think PTSD). Or their race? Yes, the latter was the basis of original Democrat gun control laws during reconstruction.

People who have not committed any crime should never have their rights removed. If there is a mental illness issue, do the right thing and get them help, make them feel safe - which would include allowing them to protect themselves with a weapon.

I think many people desire gun control because they do not feel safe. That points to a fundamental problems in law enforcement and the criminal justice system. That is where the conversation needs to be. Fix the government so that real criminals are taken off the street - after they have committed real crimes. Be consistent about it. (I'm sure you can come up with many ways there is inconsistency these days.) Give criminals real sentences. Make them do the time. Restore people's confidence in the criminal justice system and they will feel safe and it will lessen the calls for gun control.

Yeh, for instance the “gun show loophole”. While it’s true that a private person to person transaction is legal within a gun show in many shows it’s no longer allowed. However, these transactions are legal outside the building such as the parking lot. Btw, the Left is lying when they say they want to stop private party sales in gun shows. Their real objective is to outlaw all private party transactions unless processed through an FFL holder and a background check. This would include transactions between neighbors and friends, relatives, bequeaths to children, grandchildren and such. Btw, this would not only eventually create a nation registery of all privately held guns it would also make the transfer cost to prohibitive and complex for most people. And btw #2, make ignoring this law a felony.

My father in law’s neighborhood started to go the the dogs. I lent him a handgun to keep in his bedroom. The dims want to criminalize this.

But the lawmakers live in guarded gated homes with plenty of protection.

biden is a liar that sets all records and his son has learned from his father.. both are an embarrassment to the nation.

money... children ..trafficking... he has no moral standards.. the whole family lacks respect for a clean life

Understand and agree. Never trust a Democrat. I’m 76 and own several guns and have been thinking about bequeathing most of them to my children, grandchildren and some other relatives. Guess I’ll need to keep an eye on the news before the Dems make it against the law and a felony. Wouldn’t want to cause problems for my family.

I think the sumbitch also said something to the effect that online sales are unregulated-no background checks-which of course is as big a lie as there is. They go from the seller to an FFL dealer near the buyer who in turn conducts the background check.

The man is simultaneously a pathological liar/cheater/plagiarizer/fraud/gonef while at the same time being very ignorant.
