Senate filibuster's racist past fuels arguments for its end

Once obscure, the Senate filibuster is coming under fresh scrutiny not only because of the enormous power it gives a single senator to halt President Joe Biden’s agenda, but as a tool historically used for racism.

Senators advocating for changes to the practice say the procedure that allows endless debate is a Jim Crow-relic whose time is up. Among the most vivid examples, they point to landmark filibusters including Strom Thurmond's 24-hour speech against a 1957 Civil Rights bill, as ways it has been used to stall changes.

Carrying echoes of the Civil Rights era, the Senate is poised to consider a sweeping elections and voting rights bill that has been approved by House Democrats but is running into a Senate Republican filibuster.

“Senate Democrats will soon face a choice: Protect our democracy and pass the For the People Act, or protect the filibuster — an outdated and abused ‘Jim Crow relic’ that deserves to be tossed into the dustbin of history."

The top-ranking Black member of Congress, House Majority Whip James Clyburn, warned senators recently that he would not be quiet if they used the filibuster to halt action on raising the minimum wage and other Democratic priorities. “We’re not just going to give in to these arcane methods of denying progress,” the South Carolina Democrat said.

But it would take all Democrats to agree to change the rules, and some centrists, including Sen. Joe Manchin, D-W.Va., are not on board.

"There is no circumstance in which I will vote to eliminate or weaken the filibuster," he wrote in a recent op-ed.

Harvard Law professor Michael Klarman said, “There’s nothing partisan about saying the filibuster has mostly been used for racist reasons, I think everybody would agree that that’s true,” he said.

DemoNazis used the filibuster to block legislation over 300 times last year. I guess that makes them racists.

The Democrats established the Rulle of 22 for the Filibuster. If it was for racism, then the Democrats did it.

“Adoption of Rule 22 occurred because Wilson and the Democrats framed the rule as a matter of national security. They fused procedure with policy, and used the bully pulpit to shame senators into reform.

Second, why did senators select a supermajority rule? A bipartisan committee was formed to negotiate the form of the rule. Five of the six Democrats supported a simple majority rule; one Republican supported a supermajority rule, and one Republican preferred no rule. Negotiators cut a deal: Cloture would require two-thirds of senators voting. Opponents promised not to block or weaken the proposal; supporters promised to drop their own proposal for simple majority cloture—a proposal supported by at least 40 senators. The cloture rule was then adopted, 76-3.”

C’mon Man! Everyone knows it’s completely different when democrats do it.

And why should there be a Senate anyway? That’s antidemocratic! Hicks in Wyoming have the same number of Senators as sophisticates in California or New York.

As I understand this argument, it’s essentially that pre-1960 when Democrats abused the filibuster so that they could perpetuate their racist policies, we should now get rid of the filibuster so that Democrats can again abuse the legislative process to perpetuate their quest for endless power.
