Biden declares, ‘No amendment to Constitution is absolute’ as he rolls out gun measures

President Biden on Thursday announced a slew of new gun control measures after a recent pair of high-profile mass shootings, and insisted the Second Amendment doesn’t grant an absolute right to own guns.

Biden presented the executive actions in the Rose Garden, joined by Attorney General Merrick Garland and Vice President Kamala Harris.

“No amendment to the Constitution is absolute,” Biden maintained, pointing to the famous Supreme Court ruling that you can’t yell fire in a crowded theater as part of the First Amendment’s free speech clause.

Oliver Wendell Holmes made that remark as " Dictum" or "Obiter Dictum", not "Ratio Decidendi" in "Schenck v's USA" which was effectively overturned in "Brandenburg v's Ohio". So not only was it never a binding precedent it has since been overturned.

Strange women Presidents lying in pondsbasements distributing swords executive orders is no basis for a system of government. Supreme executive power derives from a mandate from the masses, not from some farcical aquatic signing ceremony.( With apologies to the Pythons)

The Constitution provides a procedure for dealing with an imperfect amendment. It’s the AMENDMENT procedure.

It is NOT via any Executive Order

“Shouting fire in a crowded theater” is a popular analogy for speech or actions made for the principal purpose of creating panic. The phrase is a paraphrasing of Justice Oliver Wendell Holmes, Jr.’s opinion in the United States Supreme Court case Schenck v. United States in 1919, which held that the defendant’s speech in opposition to the draft during World War I was not protected free speech under the First Amendment of the United States Constitution. The case was later partially overturned by Brandenburg v. Ohio in 1969, which limited the scope of banned speech to that which would be directed to and likely to incite imminent lawless action (e.g. a riot).

The paraphrasing differs from Holmes’s original wording in that it typically does not include the word falsely, while also adding the word “crowded” to describe the theatre. The original wording used in Holmes’s opinion (”falsely shouting fire in a theatre and causing a panic”) highlights that speech that is dangerous and false is not protected, as opposed to speech that is dangerous but also true.
