Arkansas senators declare federal gun laws null and void within state borders

LITTLE ROCK, Ark. (March 31, 2021) – Today, the Arkansas Senate passed a bill that would take on federal gun control, past, present and future, banning the state from participating in the enforcement of a wide-range of acts dating back to 1934.

Sen. Gary Stubblefield (R) and Sen. Brandt Smith (R) introduced Senate Bill 298 (SB298) on Feb. 8. The legislation would ban any person, including any public officer or employee of the state and its political subdivisions, from enforcing any past, present or future “federal statute, executive order, or federal agency directive that conflicts with Arkansas Constitution, Article 2, § 5, or any Arkansas law” relating to the right to keep and bear arms.

On Tuesday, the Senate City County and Local Affairs Committee passed SB298. Today, the full Senate approved the bill by a vote of 28-7.

This legislation is similar to a bill moving forward in Missouri.

DETAILS OF THE LEGISLATION

The bill includes a detailed definition of actions that conflict with the right to keep and bear arms under the Arkansas constitution and that would not be enforced by state officers, including but not limited to:

The National Firearms Act, 26 U.S.C. § 5801 et seq. The Gun Control Act of 1968, 18 U.S.C. § 921 et seq. taxes and fees on firearms, firearm accessories, or ammunition not common to all other goods and services that would have a chilling effect on the purchase or ownership of those items by law-abiding citizens; registration and tracking schemes applied to firearms, firearm accessories, or ammunition that would have a chilling effect; any act forbidding the possession, ownership, or use or transfer of a firearm, firearm accessory, or ammunition by law-abiding citizens; any act ordering the confiscation of firearms, firearm accessories, or ammunition from law-abiding citizens.

Will Arkansas or any other state confront Federal officers if they attempt to enforce Federal firearms laws on their own? In California, the authorities prevented Federal immigration officers into state or county run prisons to prevent the Feds from deporting criminal aliens in the country illegally. We will see if conservatives have the same resolve in the Second Amendment sanctuary states as liberals had in the sanctuary states.

Federal (and big business) challenges to the 2nd Amendment, state voting laws, federal enviornmental mandates etc. etc. need to be met by active and cohesive efforts of a conservative states alliance led by the governors of red states. We are being picked apart in isolation. A good example is the heat being brought on GA for its recent voting legislation. It would be tough to boycott say 23 states as opposed to one as clebrities, big business and the government always do when a state does something that challenges their progressive agenda. We need leadership, numbers and unity if we ever expect to take back this country.

Okay so the state won’t enforce them. But are there any provisions to prevent the feds from enforcing them in the state?

This is the crux of the matter. While this bill if made law would be a step in the right direction it still does nothing to stop the feds rein of terror on law abiding citizens. States need a law that nullifies all federal gun laws and makes any attempt at enforcement by federal agents a felony offense in the state.

And that is what will be needed, and then we woud see if Biden's remade military would fire on state forces and citizens within our own borders.

If it does get signed, we’ll see if they can hold out. The federal government has MASSIVE POWER when it comes to enforcing compliance (try not paying your taxes and you’ll be getting just a small taste of that power).

Another good step, albeit it costly, would be to take over maintenance of the State’s National Guard. Years back, the Feds pulled the National Guard out of Minnesota (IIRC) for some good will aid in Central America, and the Governor objected.

The Feds told him, in effect, “We pay for their upkeep, so we can send ‘em anywhere.”

If there is any confrontation between Fed and State, all they have to do is Nationalize the NG and the State is screwed, for the next level of defense is the State Police - and how many of those exist?
