No, Gov. Kristi Noem Is Not Playing 4-D Chess on Women's Sports. Here's How We Know

Last Friday, Gov. Kristi Noem (R-S.D.) issued a “style and form” veto against a bill to protect fairness in women’s sports. She claimed she supports the bill but urged alterations that arguably “neutered” the legislation. This week, Noem has vociferously defended her action, claiming that she had to weaken the bill in order to win the longer-term battle against woke activists who would have issued powerful boycotts against South Dakota had she signed the legislation.

“I’m not interested in picking a fight that we can’t win,” Noem told Tucker Carlson.

I am sympathetic to Noem’s argument and I wanted to believe her. After all, when Gov. Pat McCrory (R-N.C.) signed House Bill 2 — which designated public non-single-stall restrooms along the lines of biological sex instead of gender identity — “woke” business leaders mounted a powerful campaign to boycott the state and the NCAA canceled sports tournaments. This pressure campaign succeeded in getting McCrory to weaken his legislation through an executive order.

I also happen to like Kristi Noem. She has taken important stands against the Left on a host of issues, such as COVID-19 lockdowns, abortion, religious liberty, and more. She claimed the veto is a temporary measure and that she was launching a new coalition of governors to defend women’s sports together.

Two of my colleagues at PJ Media — Stacey Lennox and Brian Darling — took Noem at her word. Darling claimed Noem was playing 4-D chess, accepting a small sacrifice for a long-term strategy.

I’d love to believe that, but the evidence does not support it.

In the weeks before her veto, Noem refused to meet with advocates of the bill to protect women’s sports. Also, coalitions like the one Noem claims to have started already exist.

TWO ARGUMENTS ARE BEING PRESENTED TO SUPPORT KRISTI NOEM’s ACTIONS:

* There’s the claim that Noem is “rounding up states to oppose biological males competing in college athletics without the fear of the NCAA making an example out of one state.”

This would perhaps make sense if South Dakota was the first and only state pursuing such legislation. But in reality, two states have already enacted such laws (Idaho and Mississippi), one has passed a similar law awaiting a signature from its governor (Arkansas) and dozens of others have had legislation introduced. Noem doesn’t need to start a new coalition — there’s one that has been building already for quite a while now. What that coalition needs most is for Noem to join with these other states in standing up to the NCAA’s threats.

* There’s also the claim that “Noem is trying to both protect her state’s male and female athletes from the woke NCAA punishing South Dakota for passing this law and her efforts to focus on strengthening Title IX.”

If that is truly her aim, she is failing to do either. By effectively killing the bill (the changes she is suggesting to the bill render it unenforceable and will likely be rejected by the legislature), she is not protecting her state’s female athletes; she is leaving them completely vulnerable to the dictates of the woke NCAA. And by refusing to sign the bill, she is signalling weakness and blunting the momentum toward taking real action to protect Title IX.

Bottom line (and ALAS): Gov. Noem is trying to pull a fast one on conservatives; making it seem like her surrender to threats from the NCAA, Amazon, etc. is actually her following a ‘nuanced’ strategy to protect women’s sports. But the best thing she could do right now for female athletes in her state, and nationwide, is to sign the bill, and not doing so, no matter how she spins it, will actually prove to be a hindrance to efforts to defend girls’ sports and Title IX.

This attack on Noem is just a Karl Rove attack on a conservative that stood strong when all around her buckled. Noem does not want the all out attack on SD that would happen when the NCAA bans all the SD colleges from sports. If you can’t figure out what she is for and what she is doing, then you are just an operative for another candidate. This is the kind of stuff that gets us McCain and Romney. You create a purity test for the best candidates. And we end up with Romney.

She did what Mike Pence did with RFRA in Indiana. She feared the woke mob more than she trusted her constituents. And, more than anything, Big Tech more than likely threatened the state in big ways. They wield a lot of power and are decidedly bankrupt in their morality.

The pressure was too much and she caved. That’s my guess.

"Women in NCAA sports" is part of the problem here.

Barring men from women's sports is such a no-brainer that it's almost ludicrous to even enshrine it into law. The female competitors themselves should be the driving force behind this, instead of relying on a state legislature to "fix" it.

I have a whole different view on this idiocy, and I've posted two general points on it in the last couple of days:

1. This might sound harsh, but whenever I read a story about a stunted mutant boy setting records in a girls’ sports event, the thing I find almost more disturbing than anything else is that the girls actually bothered to compete in the event instead of walking off the scene in disgust.

2. If you're involved in something as extraneous to human existence as a women's sports program and you need a state legislature to "protect" you from something like this, then I'm afraid you have already resigned yourself to a long life of mediocrity.

I don't necessarily agree with this.

You'd probably be disturbed to find out how many of her so-called "conservative" constituents are willing to sacrifice their political and moral principles when such non-negotiable essentials in their lives such as "March Madness" and college football playoffs are at stake.

Her defensive posture in that interview with Tucker said a lot. The protest she is forming a coalition sounded very much like, forming a committee, government’s solution to every problem. And I personally think that coalition would’ve formed very quickly if the NCAA attacked South Dakota for preventing men from competing against women. The polls show Americans are overwhelmingly against that.

Women’s Tennis Champion Serena Williams once played against a male ranked 200 ( or more, can’t remember) in the Men’s Tennis rankings.

She was defeated in straight sets and the guy didn’t even have a break a sweat. She said he returned every hard shot she gave that would have defeated any female opponent she played against.

I joked to my buddies when I showed this news and said, if this guy wants to make top money in tennis instead of languishing at the bottom, he should become a transgender like Bruce Jenner and insist on joining the Women’s Tournament instead.

He only gets to play a maximum of 3 sets instead of 5 and he’d be a tennis legend. :)

how many high school athletes are former boys currently identifying as girls in the entire state of SD?

Pull a fast one? The GOP had developed a "pretender" complex where no matter what someone is a pretender conservative if they don't toe the line. I don't think it is helpful to label someone like Noem a closet liberal who somehow found herself to be a Republican Governor. Yet that is what seems indicated when we say she is "pulling a fast one" over on conservatives, as if her heart on the issue is really with the liberals. I don't get it.

There are surely powerful interests in politics and sometimes those play a role in a state's or constituency's well being. Everything is not always ideologically binary.
