The press is using twisted legalese and manipulating the legal standard to confuse the issue, as they have done before in other high-profile cases. Ms. Powell’s statements were legal opinions that she stands behind, as they were based on sworn affidavits, declarations, expert reports and documentary evidence.
- Dominion claims that the evidence Ms. Powell relied upon to assert her claims concerning the lack of election integrity is incredible and not believable. Ms. Powell responded by pointing out that her assertions were her legal opinions based on the evidence she presented to four different courts. Accordingly, her statements are not subject to challenge under defamation law."
Powell (who btw, isn't my favorite lawyer and I view as a showboater) is saying in effect that the statement weren't defamatory but were "claims" and only after a court case with facts being presented could the veracity of such claims be adjudicated.
Such characterizations of the allegedly defamatory statements further support Defendants' position that reasonable people would not accept such statements as fact but view them only as claims that await testing by the courts through the adversary process."
Thank you Tennessee Conservative for your post #15. Would that more people on this site would do their own research and not believe every negative story from the fake news. The lamestream media will do everything possible to destroy Sidney Powell. This answer and explanation from her attorney about how this lawsuit is being handled requires some actual time and reading comprehension to understand. That must be why so many people seem to be confused!!
It’s not a legal opinion whether or not Dominion was founded by or on concert with a Venezuelan dictator.
That is something that can be proven or verified.
To make is simple, the hinge of the argument is the court challenge. Reasonable people do not treat things as fact prior to the challenge, but would consider it fact after the evidence is presented in the court challenge. That is the part that the critics here seem to be missing.
