The Center for Disease Control has issued a new coronavirus order requiring DOUBLE masks to be worn for all forms of public transportation in the United States.
From CNN:
The CDC announced an order late Friday that will require people to wear a face mask while using any form of public transportation, including buses, trains, taxis, airplanes, boats, subways or ride-share vehicles while traveling into, within and out of the US.
The order goes into effect at 11:59 p.m. Monday.
Masks must be worn while waiting, boarding, traveling and disembarking, it said. The coverings need to be at least two or more layers of breathable fabric secured to the head with ties, ear loops or elastic bands — and scarves and bandanas do not count, the order says.
The CDC said it reserves the right to enforce the order through criminal penalties, but it “strongly encourages and anticipates widespread voluntary compliance” and expects support from other federal agencies to implement the order.

The reason they say indoor dining is dangerous is that the staff comes down with it. Those who have interacted with a large percentage of the people who used the restaurant.
And then of course they bring it home. Most of them live with other people.
They knew that before they tried to institute contact tracing of everyone who ate indoors.
Most masks have two or more layers. What this prohibits is the use of bandana or scarf.
Congress won’t touch this. One side gets to use this issue to grouse, the other side can crow. Nothing better than grousing and crowing without acting. No accountability, vote for me!

The CDC is a government agency.
It is allowed to write rules and regulations that concern public health, and that carry the force of law.
However, unless the President has declared the transmission of the COVID virus to be a national health emergency, new CDC rules and regulations are required to have a specified period of Notification, Comment, and Review.
If the President has declared COVID - which kills less than 1% of its victims - a national health emergency, I have not heard about that.
I wonder if that will include the trips to the gulags?

So, I guess that the answer to your question is: Yes, besides Congress, we now also have a second legislative body capable of issuing laws.
I am assuming that Congress once passed some law giving the CDC that particular power.

Air resistance increases quadratically to (according to the square of) the speed.
Thus, if you're taking shallow breaths (e.g., when sitting quietly in a chair), your mask may not significantly impede breathing.
If, however, you are exerting yourself (e.g., walking briskly), the resistance caused by the mask could easily increase 16-fold.
