Supreme Court Rebuffs Bid for Universal Vote-by-Mail in Texas

The U.S. Supreme Court turned away a Democratic bid to force universal vote-by-mail in Texas, leaving intact a state law that lets people cast no-excuse absentee ballots only if they are 65 or older.

The Texas Democratic Party and its allies argued unsuccessfully that the law violates the Constitution’s 26th Amendment, which says the right to vote “shall not be denied or abridged by the United States or by any state on account of age.”

Voting by mail became a sharply partisan issue amid President Donald Trump’s unsupported contentions that the practice led to widespread fraud in the November election. Texas’s Republican governor and attorney general urged the Supreme Court to reject the Democratic appeal.

A divided federal appeals court in September rejected the 26th Amendment claim, saying the Texas law didn’t make it more difficult for anyone to vote. The panel left open the possibility the law could be challenged as a violation of the Constitution’s equal protection clause.

The Supreme Court also rejected Texas Democrats in June, when the justices refused to reinstate a trial judge’s order that would have let any voter request an absentee ballot to avoid the risk of contracting Covid-19. That order, which was blocked by the appeals court, was designed to govern the 2020 election and might have boosted Democrats’ prospects.

The 26th Amendment, which was ratified in 1971, extended the right to vote to people 18 and over.

The case is Texas Democratic Party v. Abbott, 19-1389.

Attempting to get legislation from the bench.

Funny, the Supreme Court rejected this, which is no different than the Pennsylvania non- legislative change to their absentee ballot process and return deadlines.

We live in bizarro world where the rules are made up, applied only when convenient, and the points don’t matter.

did they actually rule or did they just refuse to hear it? I suspect the latter. It’s John Roberts new path to negating the five votes on the conservative side: just refuse to hear anything important and let lower courts decide everything. On balance he’ll get mostly leftist rulings that way.

Just a reminder. The Harris County Clerk attempted to send out 2 million mail in votes before AG Paxton stopped her. Never ever think ‘rats have any intention of abiding by the law. We live in a lawless nation.

I believe the word "rebuffs" in the title answers that question.

Forget all of the patently ridiculous "Dominion software vote switching" hogwash. Harvesting mail-in votes, or outright fraud in filling out absentee ballots in the name of people who haven't voted for many years is how the election was stolen.

Something has to be done to secure mail-in voting if the practice is to be trusted.

Voter ID laws in many states effectively killed in-person voter fraud. Someone smarter than I am (that opens up the field by quite a bit) needs to come up with a way to secure and verify mail-in ballots.

My initial thought is that mail-in ballots must permanently be tied to the voter. If you want ballot secrecy, vote in person. Want to vote by mail, you forfeit your right to anonymity.

Looks like everyone is making it up as they go?

I think the News just enjoys its story of tension around DC, now they think they can gain stories by focusing on Trump supporters and white supremacy.

They don’t want to become irrelevant like when Obama was president.

I think scanning the same batch of ballots in the middle of the night when Republican observers were gone might have contributed a little to the fraud.

You’re probably correct.

I’d wager that dominion’s only part was giving real time vote totals to democrats so they know how many ballots are needed to overcome a republican lead.

“It’s John Roberts new path to negating the five votes on the conservative side: “

They are not going to waste their time on a case which their ruling changes nothing.

under HarrisXiden Regime mail in ballots will arrive at your mailbox already filled out. You only need sign the ballot.

Failure to sign will mandate a visit by the Federal authorities, possible jail or prison time and hefty fine (amount determined by the size of your net worth).

Outlawing the Democrat party is the only way to secure any aspect of the voting process.

They BETTER have.

They made it clear that it was purely the power of the state to make their voting laws.

That’s for 2022. In 2024 ballots will be sent, pre-signed, directly to the vote counting center. In 2026 only the vote total will be sent, electronically, to save on paper.

The GOP needs to get rid of mail-in ballot elections or they will lose.

When do the “People” get to see the mail in ballots that are being held for 22 months? Why even have the law if it’s worthless.
