Harvard Law professor emeritus Alan Dershowitz said that the house violated six independent points of the Constitution when impeaching President Donald Trump.
In an interview with Newsmax, Dershowitz said: “They violated the free speech provision. They violated the impeachment criteria. They violated the bill of attainder. They violated due process, on and on and on.”
“How can you impeach a president for a speech that is constitutionally protected?” he said.
The law expert said that Congress is not above the law, but that ironically, they have protection from culpability for what they do on the Senate floor.
“But the only sanction is to vote them out of office and to bring them to trial in the court of public opinion,” Dershowitz told host Carl Higbie. “Senators and congressmen are immune from lawsuits for what they do or say on the floor of the Senate, so there can’t be any personal lawsuits.”
“The Constitution is very clear, the purpose of impeachment is removal,” he said. “The Senate cannot try an ordinary citizen.”
On a single article of impeachment, the House voted 232–197 to impeach President Trump, on Wednesday for “incitement of insurrection.” Democrats and 10 Republicans contended Trump incited the Jan. 6 breach of the U.S. Capitol.
Trump is the third president to be impeached and the first to be impeached twice. No president has ever been impeached and convicted and no president has ever been placed on trial after leaving office.
A single 7-hour impeachment hearing session constituted the fastest impeachment in U.S. history.

Sounds about right. They might be baring their teeth at Biden for leverage.
But when we take a hard look at the latest porkulus, there we see the ugly truth. Most as clandestine agents for foreign powers.
I hope and pray the military figures this out.
Nothing new, Pelosi falsely certified Obama as a natural born citizen, but only to Hawaii, she tricked the rest of the states into doing it for her.
I will look it up. Thanks for helping me be smarter.
Yes, I know Trump didn’t intend that the walk to the Capitol be unlawful. He was great, we were pumped, and so ready to show our support. It was great. Until it wasn’t.
All you said, TRUE! And
>>The USA left to the wolves.<<
Plus the wolves in sheep clothing, RINOS, but thanks to prayer and President Trump, they are exposing themselves. Saving us the headaches and troubles of exposing them. Self evident?
Take care........pilgrim
Ignoring the Constitution began with Teddy Roosevelt. Education grew increasingly perverse after Woodrow Wilson’s reforms (prior to being President).
But when Biden started the dem tradition of borking qualified judges the pace sped up drastically.
Borking is now an official word in the dictionary. “Unfair political attack.”
Listening to Lou Dobbs, asking Jason Chaffetz about the Democrats dispensing with rule of law and railroading the President with a second impeachment.
Chaffetz response: “These people need to be voted out.”
*facepalm*
Chaffetz, we’re in this mess right now because voting doesn’t help. They cheat.
Does no one remember that anymore?
Next up, the Chineze vacation babies as POTUS. Congress will applaud!

self-serving leverage. Either you give me .... or we disclose. Well, son of a B, we got what we asked for!
Yes, Trump’s service is EPIC. Most amazing first term ever. No other president came close for first term.
And no one should expect him to do more than he did. He is no lawyer either. Might have been his blind spot.
We will see in a few days.
Don’t think you missed anything!
Think some fringe were easily led by provocateurs and others. Maybe easily led. Personally do not think or would not think of entering the Capitol in a mob. At least hope so!
On Bannon an ‘accelerator group’ was mentioned. Had not heard of them. Need more information. I forget about the ‘right extremist’ groups. Personally identified as a right extremist so it passes my understanding of the possibility of people to my right.
Thought for a little while my standing was to the right of ‘Atilla the hun’, but guess there are some ‘righter’? :^)
A cousin, from Fort Worth, TX sent a list of accomplishments. I thought I knew most. Not a chance. It was a list, at least, a full legal sized sheet, single spaced. Had not known about two thirds of what he has done.
imo, he is at the top, if not the top, President we have ever had. At the age of 85, think he is the top! Do not ever expect to see anyone approach his accomplishments!
Thanks!
As long as we have cowardly republican senators, we have no recourse.
An admirable job of explicamashun as to why both Impeachments were Unconstitutional. Duh. As if I need Dersh for that.
No, what Dersh intentionally leaves out, is that Pelosi is overcoming the 'fear' of impeaching Xiden when he refuses to leave after she convenes her 25A Committee. All the freshman Donks who eagerly voted yes to impeach President Trump are now soft and pliable to do the same thing to Xiden in 9 months.
But Nancy made a yuge tactical error in that regard -- this 7-hour Impeachment was purely driven by emotions, someone took her podium and someone else put his muddy feet on her desk. Boo. fucking. Hoo.
You and I know it's hilarious. I mean, I laughed and laughed and laughed, like I haven't laughed in a long time.
But back to the point -- when Xiden refuses to go viz Madame Defarge's 25A Committee, she will attempt to become the first and last Speaker in American history to attempt to Impeach 2 Presidents in the same year.
And even that absolute madness will sober up the MSM post-haste. A power-mad, wretched harridan wreaking pure havoc in the effort to design Presidential succession to her own personal whims.
This will be the next tipping point.
“He knows he has constitutional power but he would look like a dictator.”
So what? They already think that.
If you have the power to save a nation, wouldn’t you?
‘Unity” for the left only means unite with their agenda and don’t oppose them.
They made impeachment meaningless it will be a common practice with future administrations just not liking the policies of the guy in charge
The point of that clause is so seditionist remarks could be made. So POTUS couldn’t charge a Congressman for speaking his mind.
