House Committed Six Violations of the Constitution During Impeachment: Alan Dershowitz
The Epoch Times ^ | JANUARY 16, 2021 | SAMUEL ALLEGRI

Harvard Law professor emeritus Alan Dershowitz said that the house violated six independent points of the Constitution when impeaching President Donald Trump.

In an interview with Newsmax, Dershowitz said: “They violated the free speech provision. They violated the impeachment criteria. They violated the bill of attainder. They violated due process, on and on and on.”

“How can you impeach a president for a speech that is constitutionally protected?” he said.

The law expert said that Congress is not above the law, but that ironically, they have protection from culpability for what they do on the Senate floor.

“But the only sanction is to vote them out of office and to bring them to trial in the court of public opinion,” Dershowitz told host Carl Higbie. “Senators and congressmen are immune from lawsuits for what they do or say on the floor of the Senate, so there can’t be any personal lawsuits.”

“The Constitution is very clear, the purpose of impeachment is removal,” he said. “The Senate cannot try an ordinary citizen.”

On a single article of impeachment, the House voted 232–197 to impeach President Trump, on Wednesday for “incitement of insurrection.” Democrats and 10 Republicans contended Trump incited the Jan. 6 breach of the U.S. Capitol.

Trump is the third president to be impeached and the first to be impeached twice. No president has ever been impeached and convicted and no president has ever been placed on trial after leaving office.

A single 7-hour impeachment hearing session constituted the fastest impeachment in U.S. history.

Biden explained this as the “Six Degrees of Separation from the Constitution”.

Hate to ask but, how will they be held accountable?

Only the ballot box and the d-rats control that as of now.

Pence was supposed to follow the conscripts of the Constitution, not take advice from the house parliamentarian.

The Constitution means nothing now. There is no law, at least no equal justice under the law.

“how will they be held accountable?”

My thoughts exactly. I feel our hands are tied. That a law professor stated this really doesn’t matter. The libs continue to berate and exploit us, and our Republican representatives continue to roll over in submission. The ‘walk to the Capitol’ showed our fury, but the aftermath damaged our message. IMO.

-- ... how will they be held accountable? --

They'll pay penance by endorsing a fraudulent election, an ineligible vice president, and making it a crime for anybody to question.

Dershowitz better watch out. He's questioning Congress, which is obviously inciting insurrection.

“They’ll pay penance... .”

You are so hopeful, much more so than I, and I believe in the power of positive thinking. Most times.

“Senators and congressmen are immune from lawsuits for what they do or say on the floor of the Senate, so there can’t be any personal lawsuits.”

I am sure the same applies to all Democrat presidents but most definitely not Trump!

jmo, do not think the ‘walk to the Capitol’ was meant to be what it was perceived. Hope you understand that.

Could say more but discretion.

Heh. Suggest you read what the penance consists of. Congress does evil things, and calls them good.

Through all of this, Biden still calls for unity and Pelosi drives ahead with an impeachment push to punish Trump for interferring with the democratic platform for 4 years. That is not unity or anything like it. Pelosi is a nasty individual who is going after Trump for getting in her way. Biden’s call for unity is hypocritical obviously. It means nothing except another empty democratic promise. If Pelosi would back off, I would believe that the democrats mean unity. But she won’t. She is like a rat in the sewer going after food scraps. She is really nasty.

I took it to be like a Dr. Martin Luther King walk. After all OUR civil rights were violated.

Maybe I missed something.

Right on cue.

It's supposed to make you believe the GOP is worth spit.

They will do some epic hand wringing. All the while selling out the country.

So tempting isn’t it?

Thoughts occur to me. Odd reports. Could be nothing but tempted to share glimmers of hope.

Trump is packing. He knows he has constitutional power but he would look like a dictator. So it all appears over.

The USA left to the wolves.

How it appears. If not true, then it is SUPPOSED to look that way regardless.

Our government has been violating the Constitution since I can remember. And I started watching during Nixon/Lodge. Young then not so much now.
