White House trade adviser Peter Navarro said in an interview on Fox News that the Jan. 20 date of Inauguration Day could be changed.
Navarro made the remarks on “Justice With Judge Jeanine” on Jan. 2, in the context of a recent call by 11 Republican senators for Congress to appoint an electoral commission to conduct an emergency 10-day audit of the election results.
Program host Judge Jeanine Pirro asked Navarro about his expectations for the effort, saying, “All this has to happen before January 20. Do you have any hope that this can succeed?”
“Vice President Pence, he has the authority to give that 10-day window to do what needs to get done,” Navarro said. “I cannot imagine when he looks at the facts he won’t vote the right way on that.”
Pirro responded by saying that the “10-day window” could change the date for certification of electoral votes planned for the Jan. 6 joint session of Congress, chaired by Pence, when lawmakers certify the votes cast for the U.S. president by members of the Electoral College.
“January 20 cannot be changed; that’s constitutional,” Pirro added, presumably referring to Section 1 of the 20th Amendment of the U.S. Constitution, which states: “The terms of the President and the Vice President shall end at noon on the 20th day of January … and the terms of their successors shall then begin.”
“It can be changed, actually,” Navarro said. “We can go past that date. We can go past that date if we need to. And we have got to get this right. … We need to take [the election] back for the people.”
Pirro didn’t ask Navarro to clarify further.

The path is there. Disqualify the fraudulent votes, if they cannot be separated from the valid votes? deny the State their electors.

If there is no "qualified" President or Vice President, Congress can set a law on who gets to "fill in".

Hmmm? Here's who it will not be. If President Trump is not declared the winner tomorrow, he will not be able to "fill in" - unless Congress approves it.

Navarro obviously is not a Constitutional scholar and hasn’t read the 20th Amendment.
He needs to read Section 3 - I clumsily described how it operates.

No, that’s not the entire 20th Amendment. Here’s Section 3:
“ If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.”
So you CAN have a circumstance in which neither a President-Elect nor a VP-Elect had been chosen; I b Lieberman that the Soeaker of the House becomes Acting President. Yeah, Nanzi - but she will get nothing accomplished and there will be a huge tush to fix that, because just about no one but her wants Nanzi to be POTUS.
What I don’t understand is why Navarro is taking the lead on this without getting some attorney or historian to review. Seems like the Wild West.

You make the point that many here just dont get.
If we continue to play by the rules, it’s officially over.
So many people are so quick to say things like, Pence cant do that, it’s not in the constitution, he has no standing, or rights to toss electors.
We’ve been beating ourselves with the rules for 40 years and look where we are. The left does not care what the laws are anymore. As you say, they trample the 2A and continue to do so everyday with little to no push back.
It’s time to fight fire with fire. Let the left scream, riot, sue, in the meantime, Trump is president.
(*sigh*) Throughout his entire administration Trump has been very poorly served by the people he has appointed. The errors that they have made have caused a tremendous amount of embarrassment for the President and it's all been self inflicted. Navarro should keep quite and concentrate on areas he knows something about, whatever that is.
Perhaps the ignorance is on the part of the guy you look at in the mirror everyday? Take a gander at Section 3 of the 20th (which I posted in #15).
