The U.S. Supreme Court on Monday vacated two lower court decisions that blocked the government from excluding illegal aliens during the process of allotting congressional seats
While the Supreme Court's Dec. 18 decision will allow the Trump administration to pursue the policy of excluding illegal aliens from the apportionment base, the ruling stated: "Consistent with our determination that standing has not been shown and that the case is not ripe, we express no view on the merits of the constitutional and related statutory claims presented. We hold only that they are not suitable for adjudication at this time."

There seem to be unusual legal judgements being made.
Remember the court decision on asking about citizenship on the census, was based on some issues relating to procedures followed, and not the merits of the case?
Remember the court decision preventing Trump from doing away with the DACA program, also was based on some technical procedures, and not a ruling on the constitutional issues with DACA?
And recent cases relating to the election have sidestepped the core issues, but instead have said that plaintiffs lacked standing to file a lawsuit.
Actually the majority reasoning appears to be quite brilliant. Gives Trump a win, while not appearing to be an activist bench on such an inflammatory issue

I think we’ve got between 5 and 10 million illegals in California.
Nationwide I think we have between 30-40 million now.
The California legislature will gerrymander the districts so that the seat lost will be a Republican held seat.

Why is this “inflammatory”?
The only people upset by it are the illegals, their co-ethnics and the hard left Rat party apparatchiks.
When it’s polled, not counting illegals for apportionment wins by big margins...usually 2:1. Most people think it’s common sense.
It’s only inflammatory to the professionally outraged wokers who try to use it to whip up a propaganda opportunity.
Doesn’t matter when voting is corrupted. When there are more votes than voters and voters that vote in multiple places, the compact is broken.
When does the apportionment actually occur? If is done in after the inauguration, and Biden is sworn in, could Biden simply reverse the policy?
If he can get a constitutional amendment....
