• Omnibus Spending Bill Text Released : The Omnibus Spending Bill Text is available now. It is a massive 5,593 page document. There is no reference to any legislative text related to HR1044 or S386 in it. Below is the summary of our review by section.
• Detail Review of Omnibus Spending Bill for HR1044 Text : We have reviewed major sections that has DHS or DOL agencies are involved and below is the summary
  • DIVISION F : This is the first section related to DHS and has title : “DIVISION F—DEPARTMENT OF HOMELAND SECURITY APPROPRIATIONS ACT, 2021″. It runs from Page 656 to 729. There is NOTHING that is related to HR 1044 or S386 is in this section.
  • DIVISION H : This section has Department of Labor. is called as ” DIVISION H—DEPARTMENTS OF LABOR, HEALTH AND HUMAN SERVICES, AND EDUCATION, AND RELATED AGENCIES APPROPRIATIONS ACT, 2021″ . As we checked, there is NOTHING that is related to HR 1044 or S386 is in this section. There are some provisions for H2-B workers added, but nothing related to H1B LCA or PERM.
  • DIVISION O : This section has called ” DIVISION O—EXTENSIONS AND TECHNICAL CORRECTIONS” has an item called “Title I—Immigration Extensions“. It is from Page 2468. There is NOTHING that is related to HR 1044 or S386 is in this section. There are some provisions to increase the H2B workers as needed, when demand is high with some conditions. But, nothing related to H1B LCA or PERM.
  • OTHER Sections : There are no relevant H1B, Green Card or PERM related clauses or any language related to HR1044 or S386.

• Voting on Omnibus Spending Bill : Today, very likely the voting may happen on this bill. But, it is not relevant for HR1044, S386 anymore.

• Social Media Rumors, Feedback : Attorney Greg confirms that there is no trace of HR1044 or S386 related language text in the Omnibus Spending Bill.
