Supreme Court shoots down Texas lawsuit, but it isn’t over yet: Unless President Trump concedes, there are still plenty of options available.
NOQ Report ^ | 12/11/2020 | CQ Livingston

Posted on 12/11/2020 5:12:26 PM PST by SeekAndFind

The Supreme Court moved today to dismiss a case brought forth by the state of Texas to delay selection of electors in Wisconsin, Pennsylvania, Michigan, and Georgia. This is a blow to the Trump campaign’s hopes of correcting the election results that were fabricated by widespread voter fraud.

According to the Supreme Court, they denied the request over lack of standing. As The Right Scoop noted:

The Supreme Court has DENIED Texas Attorney General Ken Paxton’s lawsuit, which was signed onto by multiple states and supported by over 100 member of congress. There was a dissent from Alito and Thomas, but it seems to have been based on matters of jurisdiction and not the merits of the lawsuit.

Notably, the three justices appointed by Trump did NOT dissent from rejecting the case.

While this is a huge “downer” for many Trump supporters, the fight is far from over. As JD noted in the last episode of NOQ Report, the best scenario is that this case bought other lawsuits more time to get in front of the Supreme Court without having to worry about the December 14 deadline for selecting electors. Now, they have to rush, which they’ve been doing already, but that doesn’t mean the fat lady has sung.

The case before the Wisconsin Supreme Court tomorrow has real legs. Lin Wood has his case docketed. Sidney Powell and the Trump campaign all have cases working their way up the ladder. Until January 20th comes or President Trump concedes, the battle continues.

According to WND:

The order said Texas did not have legal standing to bring the claim.

"Texas has not demonstrated a judicially cognizable interest in the manner in which another state conducts its elections," the court said in the unsigned order.

The court did not provide a vote count, but CNN reported that there no dissents, including among the three justices nominated by President Trump: Neil Gorsuch, Brett Kavanaugh and Amy Barrett.

Two of the court's conservatives, Justice Samuel Alito and Justice Clarence Thomas, said they would have allowed Texas to sue but would not have blocked the four states from finalizing their election results.

This is all true. Texas did not demonstrate standing, particularly because their premise was based on how other states operated their elections. If they could have demonstrated direct voter fraud to change the results of the election itself, they have had a better chance. Thankfully, there are plenty of other lawsuits coming up that do demonstrate what is needed in order to correct the results of the election.

Time is the challenge. Can these other lawsuits get in front of the right people in time? We will see.

This is a blow to the confidence of many Trump supporters, but the fight is far from complete. There are still multiple angles and several weeks before January 20. Don't let naysayer convince you President Trump isn't going to win.

Can you quote the applicable part of the 12th Amendment that requires a candidate to publicly concede? The custom of making a public concession began in the election of 1896.

RE: There is no moral basis for Trump to concede, ever.

I agree. But if the Electoral College ( God forbid ) decides for Biden, He has to leave anyway.

Leave but Don’t concede.

“I hope he doesn’t concede. I also hope he doesn’t attend the inauguration . . . or even talk to Biden at all. Seeing who does attend will tell us which politicians we can never trust again. (Most of them, I guess.)”

PDJT could certainly make a statement if he followed your advice.

There is nothing in the 12th that states a candidate must concede.

Concession is a courtesy to the other candidate and the nation.

In that scenario, Red states should withhold their votes as a declaration of war.

I think it needs to be enough to deny either candidate 270.

Congress can also challenge those electoral votes on Jan 6th. It takes one house member and 1 senate member to open debate and challenge. Rep Mo Brooks is planning on doing so.

He suggested writing your Senator which I am gong to do ted Cruz and ask him to challenge. Listen this is from December 8th but I heard Mo Brooks say this weeks ago in an interview

Trump has an obligation to not ever concede but to crush the coup. Do whatever it takes. He will have the vast majority of the country behind him.

"What if Trump refuses to concede *EVER* ?"

Not sure what you're asking.

There is no Constitutional or legal requirement "to concede."

Yes it's a nicety, but that's about it.

This is over. Biden stole the election, and our judicial system rubber stamped the steal. Now we have to figure out what the nest step is. I hope it is the decision to fight back hard and do what the democrats do. Destroy them with the same tactics they use.

There is a difference between vacating office due to expiration of term and and admitting to losing the election via fraud.

What biden state would not present that state's electors? If two or three do not send electors then the courage or cowardice of the Congress gets exposed when they are tasked with selecting. So what states (2 or 3) will hold off certifying biden electors?

I am of the opinion that such a move is THE ONLY step before the EO of 2018 is activated and the Insurrection act Activated. The sedition is blatant. The coup attempt is real and involves foreign actors. The Republic is under assault from foreign actors and the subpreme court is moot. Time for courageous CONGRESSes to act responsibly to protect and defend this Republic. If not, then the Presdient must act on his oath of office and stop this teason.

One more point: the presdient has the power to order data from the NSA which will reveal 'somoene' ordered the stop counting command to the cities where the massive ballot dumps defrauded the elections in those states. IF he does not release that information to we the people then it is he who is ultiately responsible for assassinating this We The People Republic. Until there is proof of this seditous/tresonous conspiracy HE is leading US along. Stop this bullshit now, Donald Trump.

I hope President Trump and his family aren’t anywhere near DC on Inauguration day. I don’t want to see the “other guy” welcomed at the WH or see OUR PRESIDENT at the inauguration. He has said he’ll hold a rally in DC that day - that might be ok but I would prefer he make an issue of leaving the city ahead of any festivities! The media and idiots (same thing) are going to complain and moan anyway so what difference would it make if he’s not around?

Anyone who thinks he’s going to have to be dragged out of the WH is smoking some pretty good stuff that hasn’t been made legal yet! Maybe that’s the way some dem would behave but not our President!

“This is over.”

I agree. The next step is to win the runoffs in Georgia and then concentrate on taking the House in 2022.
