There were a number of new filings today including the defendants response, motions in support, and motions in opposition. Instead of posting them in individual threads, I thought it better to offer the following in a table format.

Tarpit, thanks for the work you're putting in on our behalf.

To the President I say, stop this bullshyte NOW. You have the NSA who can quickly tell you who the 'someone' was that commanded the stop counting in Milwaukee, Detroit, Pittsburgh, Philly, Atlanta, and Maricopa County. That piece of evidence is proof of an interstate conspiracy to manipulate the election out come coupled with the command in those same cities to expel the obervers and go back to counting without licit monitoring of the ballots. The longer YOU let this 'play out' the more lies the scumedia spew onto the population, dividing the nation further. YOU can put a stop to this bullshyte by exposing the cabal doing the sedition and the crux of the illicit activity is the source of the command -to those specific cities where massive ballot fraud happened- to stop counting. Enough is enough, Mister President. YOU can stop this immediately by exposing the facts to the Americna people, and to the cowardly subpreme court.... Unless you too have decided we the people do not deserve the truth. President Trump, if you are going to counter attack, for the sake of the Nation included we the people NOW!

Hah! Your guess is as good as mine.

I know the president won this election. I don’t know the best way to resolve the urgent problem of repairing the damage done.

It’s a hell of a spot the left has put us in.

I fear a Kamala Harris presidency more each day.

The problem with asserting that Texas does not have standing is that it begs the question of who the hell does? The states committing the fraud? That is giving a free pass to vote fraud, we might as well get used to president-for-life.

With the states evenly divided on this punting just raises even bigger issues.

Agreed, although as I've thought more about it, technically it's not truly de novo, it's just that Rehnquist forced SCOTUS to punt the Equal Protection Clause argument in Bush v Gore, ie, Rehnquist knew that if SCOTUS issued any judgment on the actual count/ing, that other states would come calling.

Rehnquist also knew that any decision based on count/ing would be quickly and successfully extrapolated to balloting.

And here's where we are, the moment demands, that Alito address balloting.

BTW Bush v Gore isn't why I joined FreeRepublic but it's damn sure why I stayed.

I still think SCOTUS punts it and leaves it up the States to fix their own mess.

That would be unfair as it affects the country not just states.

It really isn’t difficult as people make it! The Constitutionality of the manner in which mass mail in ballots were permitted is the Central Issue. That is not hard to rule on. In short, if illegal ballots are ruled unconstitutional, then they cannot be part of the official count. Boom. End of story. I fail to see why this is so difficult. Justice Alito already ordered PA twice to separate out ballots received after November 3 at 8pm (which PA did not obey). What was Alito saying? That those ballots are illegal and should not be counted.

No idea on timing. Again many pundits, including a law professor from Texas, say that SCOTUS will punt on this very quickly.

If I hear the word “debunked” (or “baseless”) ONE. MORE. TIME, I’m gonna pop.

The evidence (which is massive and widespread) is NEITHER “debunked” (by anyone other than the people who perpetrated the fraud) OR “baseless”.

But, boy, does the media and the Dems (but I repeat myself..) have their talking points down cold.

Tell a lie enough times, and the uniformed will believe it. That’s obviously the game plan by the Dems and MSM.

I have read some opinions of conservative legal brains and their thinking is that 1) this election was fraudulent and 2) SCOTUS is unlikely to take THIS case because it isn’t on solid ground, constitutionally.

I don't claim to be a legal expert, but I can't see how a case could be on MORE solid ground constitutionally.

The case filed by Texas is very simple..the only body who can make law is a legislature. Not a court. Not a SOS. Not a governor. NO-ONE can MAKE law other than a legislature. And MI, GA, PA and WI all tried to by changing the voting law via the courts and/or exec branch (eg: SOS).

That's illegal, and as much as a "tee up" violation of not only the US Constitution but basic common law as it gets. There's also the issue of "Equal Protection" which says MI, WI, PA, GA can't treat their citizens in a way that advantages them in such a critical issue as voting over another state (eg: by not holding signature verification to equal standards..that'd mean a PA "absentee" voter has different rights than a say, OH voter)..no go.

If SCOTUS doesn't take it, the only reason will be political - it's certainly as "rock solid" a LEGAL case as you can get.

I agree with you- but also think SCOTUS may see it in a different light.

I don’t know how judges think or how they weigh things. I will look forward to anything Justice Thomas has to say.

To ease your concerns, consider this:
1. The Republicans have the majority in the GA, MI, PA, WI Legislature.
2. The National Republican Party will put pressure on those Legislators to overturn the popular vote and select a slate of Trump electors to the electoral college.

Keep in mind that when the Democrats impeached Trump, the Republican Senators, with the exception of Romney, voted to exonerate Trump.
