Many democrats stealthy run as “republicans” because they know full well they could NEVER win as a democrat in a Red state. They are political science grads who want power at all cost regardless of ethics. You see a lot of these RINO’s in Ohio, Tennessee, Georgia and Kansas.

Rarely do you conservatives do this in blue states.

He’s actually right; the State legislatures have that power.

However,

Supreme Court HAS the authority to order state legislatures in Georgia, Michigan, Pennsylvania and Wisconsin to toss the votes that were made that were done in a way that was unconstitutional with both the State Constitutions and the US Constitution.

I am less optimistic after reading the PA response. How do Trump’s lawyers respond to IV B of the response? Even if the state issued an unconstitutional policy, the voters of who followed it should not be disenfranchised. They followed the law. Taking away their votes is a harsh remedy for a mistake by the State.

PA claims a) lacks the seriousness deserving of original jurisdiction; b) any claims can be heard in lower courts.

The first argument strikes me as ludicrous given the claims made by Texas; and the second as ludicrous given the time constraints.

You are closest to the correct answer. SCOTUS can invalidate the elections in any or all of those states due to constitutional violations, and can tell the state legislatures that they have the power to remedy this issue themselves. Then it’s up to the state legislatures.

Also, the article is inaccurate; Yost didn’t side with the defendants. He’s kind of taken a third position that the bureaucrats and the courts cannot change the rules or decide the electors, the legislature has to do that.
