Ohio AG Dave Yost files brief criticizing Texas’ lawsuit challenging Biden win

COLUMBUS, Ohio—Attorney General Dave Yost on Thursday filed a legal brief with the U.S. Supreme Court opposing a Texas lawsuit seeking to effectively delay the Electoral College from voting Joe Biden the next U.S. president.

Yost, a Columbus Republican, stated in the brief that the Supreme Court lacks authority to order state legislatures in Georgia, Michigan, Pennsylvania and Wisconsin to appoint presidential electors. Texas Attorney General Ken Paxton’s lawsuit argues such a move is needed because coronavirus-related changes to election rules in those states opened the door to unsubstantiated claims of voter fraud.

I believe he has just ruined any chance of being elected to any political office in Ohio. I wouldn’t even vote for him as dog catcher.

Okay, so even though the constitution gives only the state legislatures governance over election laws, and it was unconstitutional for the State SoS’s, goveneror’s executive orders, and even for the state courts to decide election laws, but it’s somehow not constitutional for the Supreme court to decide the constitutionality of something????

The Supreme Court can invalidate the elector certification for the states because of constitutional issues. The states legislations can not be ordered to choose a new slate of electors. That would be their choice.

Was this written by a CNN constitutional scholar? All the talking points are in it. Too late, too early, this has been ruled on previously. And written with a very condescending attitude towards the court.

It appears that the article you posted is not completely accurate. Yost asserts that the four states have broken the rules and wants SCOTUS to clarify the Electors clause.

As an Ohio resident I am not surprised. As far back as I can remember Ohio has always been a Deep State. Particularly at the Governor and the US Senator levels. US Ohio Senator Rob Portman is Mit Romney lite who never says anything until its time to push a liberal cause.

Governor DeWine likely leaned on Yost as it is apparent by past actions DeWine is a Never Trumper.
