Breaking: 11th Circuit Rejects Lin Wood's Challenge to Georgia Election
11th Circuit Court of Appeals ^ | December 5, 2020 | 11th Circuit Court of Appeals

Posted on 12/05/2020 9:20:20 AM PST by Lurking Libertarian

The 11th Circuit just issued its decision in L. Lin Wood's appeal of the district court's denial of his request for an injunction against the Georgia election results. The decision holds that (a) Wood lacks standing, and (b) even if he didn't, any election challenge is now moot because Georgia already certified its electoral votes.

The logic of both arguments is wrong. Any GA voter can challenge the results. Granted that once the result is certified it’s difficult to attack it. But you can’t dispose of an attack simply by saying it’s been certified.

I don’t see why this should be a federal Cade though unless they were making a constitutional argument.

In the first TRO, the judge basically said that voters have no right to determine how votes were counted. And, keep in mind, the way these votes are in contrary to state laws. So, in essence, voters have no standing to ask their elected officials to abide by state law.

That should scare all of us.

This TRO was brought before the results were certified, this is an appeal of that ruling. The judge is completely wrong on that. Wood is not in control of the schedule of the courts.

Any GA voter can challenge the results.

In state court, yes. Federal courts have different standing rules.

How does Wood "lack standing" if he is an actual resident of Georgia???!!! Isn't that the very meaning of the term? And, for that matter, don't we ALL have standing since a fraudulent election in Georgia as well as other states was a cause of our votes for president to not be counted fairly and legally and our selection of President was compromised?

The other reason - that it is a moot point because the election has been certified already - ignores that the lawyers were made to wade through the process while the opposition simply ran out the clock and certified the election anyway under a huge cloud of doubt. Can they not see their actions CAUSED the doubt the entire electorate carries about the whole farce??? Even many Democrats believe the election was stolen. I'm glad this whole debacle is being exposed and those who perpetrated the criminal acts WILL face justice one way or another.

I have a theory: What if all of these rapid lawsuits are just a distraction. Keep it all in the news, keep our spirits up for the REAL SHOW... that is Sidney Powell’s Dominion Lawsuit. Frankly all these anecdotal stories are interesting, and tell a larger story, but still we don’t know if it is enough to make legislatures overturn.... The key HAS to be DOMINION. Powell sounds as cool as a cucumber. She says there is plenty of time. Thoughts?

There’s little question that Lin Wood is about what’s good for Lin Wood and that’s not good for Trump now or in 2024 if he decides to run again.

She talks a good game, but her lawyering so far has been sub-par. (She just lost in the 11th Circuit, too.) And she doesn't have much time: the safe harbor deadline is December 8, and the Electoral College votes December 14.

I haven’t been a fan of old Bill since he stabbed Justice Roy Moore in the back many years ago. Contrary to what many on this board rhink, Moore is an honest and decent man...

Pryor is one of Bush’s best appointments, and is on Trump’s list of possible SCOTUS picks. An Originalist, and a member of the Federalist Society and Heritage Foundation. For the left, he was the most feared pick to replace a SCOTUS Justice. In fact, the Democrats filibustered his confirmation to the 11th, and he was installed via recess appointment.

He is not an activist who will bend the law to fit a political agenda.

Oh baloney. What is in this for Wood? He is not making money on this and he’s certainly not doing it for his reputation. He is a Trump supporter and he filed as a citizen of Georgia.
