U.S. District Judge Nicholas Garaufis said in his six-page ruling that he was fully reinstating the DACA program based on the terms established under former President Barack Obama’s administration.

"The DACA children are unlawfully present in the USA. Consequently, I order the Secretary of Homeland Security to remove them."
That Executive Order is an exact quote from the language in the Immigration and Nationality Act of 1952.
According to the exact language in the Administrative Procedure Act of 1946, an Executive Order like that cannot even be reviewed by a federal judge.
Unfortunately, Trump never wanted to deport the DACA kids, unless they were violent criminals.
Trump's three year legal effort to "end" DACA was pure political theater.
If Trump eventually wins the election, "Comprehensive Immigration Reform" and DACA Amnesty will be his first major legislative effort in 2021.
Full disclosure - I voted for Trump in 2016 and 2020, but only because he is the most Conservative candidate who can be elected president.

Follow Andrew Cuomo’s cue: declare the judge’s ruling “irrelevant” and continue what you’re doing.
And now, we are about to lose our nation and our Constitution.
In the future it would be much easier when appeals are taken for the case to be decided simply by reference to who appointed the judge. That would be no less predictive and even more expeditious than writing actual opinions.
While I believe that DACA should be ended for any future illegals, allowing a way for those brought here as children to earn citizenship is not bad.
As a border patrol I have met people who had been here for close to 20 years, had a good job(nurse), spoke perfect English and had no criminal record. I dont know why anyone would have a problem with someone like that getting citizenship. Of course if the person has a criminal record or is a public charge then they need to lose their daca status and be sent packing.

I remember an Agent I once worked with who often remarked that he regretted the fact that he couldn’t deport TWO worthless citizens for each of the hardworking Mexicans he often sent home. From my experience, I could see where he was coming from!
This is an early indication of what’s to come and a signal to the fans that in a few short weeks, the band will be back together and the deepstate establishment will pick right up where it left off 4 years ago.
A judge establishes Federal Programs, rather than the Legislature.
That is a problem.
Judges don’t have to find the money for their preferences.
We’ve got to find and fix the flaw in our system that allows judges to usurp power like this.
Deporting law-abiding DACA children is an unpopular issue; they have almost no ties to the countries of their birth, and many are here illegally without knowing it (until they apply for college, for instance).
I never expected anyone to deport them; they are basically “residents on a probation period for citizenship”.
Maybe they shouldn’t be deported (I think they should be), but they should not be rewarded with citizenship. Maybe a green card status, but no citizenship.
So, if my father stole a diamond, I should get to keep it?
The issue is not that they are bad people, the issue is the LAW.
I still don’t understand why DACA cannot be overwhelmed with Biden ballots. “Oh senor no one by that name here.”
