Rep. Mo Brooks plans to challenge Electoral College vote on Jan. 6, report
"This election was stolen by the socialists engaging in extraordinary voter fraud and election theft measures," said the Alabama Republican.
Alabama Republican Rep. Mo Brooks plans to challenge the Electoral College votes on Jan. 6, when Congress is scheduled to certify Democrat Joe Biden as the winner of the 2020 presidential race.
Brooks has been telling his plan to fellow House members and might follow without the backing of Senate Republicans, according to Politico.
To trigger such a legislative effort, at least one member from the House and the Senate must challenge the results of the Electoral College vote.
Brooks called the November election "badly flawed," and mail-in voting "unconstitutional."
"In my judgment, if only lawful votes by eligible American citizens were cast, Donald Trump won the Electoral College by a significant margin, and Congress's certification should reflect that," Brooks told Politico. "This election was stolen by the socialists engaging in extraordinary voter fraud and election theft measures."
Brooks also said he does not believe the Supreme Court possesses the authority to overturn the results of this election.
"A lot of time is being wasted in court," he said. "The Supreme Court does not have the lawful authority to determine whether to accept or reject a state's Electoral College submissions. Under the United States Constitution and U.S. law, that is the job and duty of elected officials ... And so it's the United States Congress that is the final judge and jury of whether to accept or reject Electoral College submissions by states, and to elect who the president and vice president of the United States might be."
Brooks, who has been in Congress since 2011, is a member of the conservative House Freedom Caucus.
It's legitimate, it's right there in the Constitution and it's an excellent example of federalism:
Article II Section 1.The executive power shall be vested in a President of the United States of America. He shall hold his office during the term of four years, and, together with the Vice President, chosen for the same term, be elected, as follows:
Each state shall appoint, in such manner as the Legislature thereof may direct, a number of electors, equal to the whole number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or person holding an office of trust or profit under the United States, shall be appointed an elector.
If the (R) state legislatures do their job (after massive pressure from their constituents, no doubt), they will audit their election results and either direct their electors to vote for Trump as a result, OR fail to field a slate of electors (because time has run out). It's happened before.
With the state legislatures acting on their Constitutional authority, either Trump gets over 270, OR neither do and the process goes to the House where the 1 vote per state occurs and Trump is re-elected. [1][2].
It's going to be up to the people of those states to put insurmountable pressure on their state representatives.
Even though this would be a last ditch effort, it’s good to hear at least 1 Rep state this publicly. Now, we need to hear from at least 1 Sen to state the same.
All we need is one Senator. And all he’ll breaks lose ...

This is why our first, and best chance at excluding the fraud from the 2020 election, is through the state legislatures of those states in question on DEC 14.
The second, and less likely to succeed option is in Pelosi's still controlled house on Jan 6.

Well, no.
In court is the place to present evidence to be subjected to examination and "proved" or "disproved".
Very strong evidence has to be presented to legislatures for them to decide they need to defend the votes of the people of their state from fraud- as the Constitution provides.
That proof is being developed in the courts.

In a battle like this, every tool should be used, every forum should be tried, every piece of evidence should be presented.

so yeah..this is just for show....but God Bless him for being willing to do it.
This is his big chance to separate him from All the Rest.
