Meet the Trump Judge Happy to Break Senate Tradition for the Job

Under normal circumstances, Donald Trump’s loss in the 2020 election would have brought to a blissful end his time to nominate judges. But having ignored Senate norms for nearly four years in office, neither he nor Senate Majority Leader Mitch McConnell is prepared to start respecting them now.

Traditionally, the Senate does not confirm judges during the lame-duck period between a presidential election and when the new president and new Congress are seated in January. It’s been that way for 123 years. McConnell doesn’t care, though. He bragged to conservative radio host Hugh Hewitt in October that he would “run through the tape” and push confirmations through the end of the year. Notably, McConnell isn’t “running through the tape” when it comes to getting a COVID-19 stimulus bill through Congress. That’s just not important to him.

One of those lame-duck appointments McConnell is pushing is Thomas Kirsch II, the U.S. attorney for the Northern District of Indiana. Kirsch has been nominated to fill Justice Amy Coney Barrett’s seat on the U.S. Seventh Circuit Court of Appeals. The Chicago Council of Lawyers, which evaluates judicial candidates, noted that appellate confirmations usually take several months, at minimum; McConnell is giving Kirsch’s confirmation process just a couple of weeks.

Ya see, it was ok for Ted Kennedy aide Stephen Breyer to be nominated and confirmed to a Circuit judgeship after the election in 1980, to of course go on to be a reliable vote on the Supreme Court.

But for Trump to fill a vacancy is just horrible.

Trump has filled three USSC vacancies and he needs to be around for four more years to fill any others that might come up. For that to happen, the present 5 conservative members need to grant CERT to all challenges to this election and rule in favor of President Trump. The court needs to tell the Democrats to come back when they can run an honest election.

Let's give great credit to Democrat Presidents' persistence -- all the SCOTUS Justices they nominate are staunch, dependable 100% left-wingers. In contrast, Republican Presidents frequently nominate SCOTUS Justices who, after they get on the bench, quickly become rather unreliable, or "swing-votes" (O'Connor, Kennedy, Roberts), or even leftists (e.g., Souter). Can anyone explain that?

BS. Current justice Breyer was nominated to his original Circuit Court seat by lame duck president Carter and confirmed by a lame duck democrat senate.

Any argument about the timing of confirmations is pointless without acknowledging the effect of the Schumer policy of requiring maximum floor time be spent on each nomination (30 hours of debate). When the Democrats put on this unreasonable restriction on timeliness, any adjustment McConnell makes to mitigate that policy becomes reasonable, including confirmation votes during the lame duck session.

Ummm, yeah, no, it was far more than just ballot harvesting. Also, ballot harvesting is not legal except in a few places. Ballot harvesting needs to be made illegal nationwide though.

Trying to break the record of the number of lies one can pack into one article and one sentence?
Even a US Supreme Court Justice has been nominated and confirmed after the elections and before inauguration in the history of this country.
We used to call the fake news media Pravda.
I know Pravda pretty well. Used to read it back in the day. Right now the Americanf fake news media is a million times worse than Pravda ever was.

Good point. I wish Republican Presidents would do a better job nominating faithful conservative Justices.

For the reasons you cite, the matter should be decided by state legislatures. If not there, then ultimately by Congress.
