Supreme Court weighs Trump bid in census case

WASHINGTON (NewsNation Now) — The Supreme Court on Monday heard oral arguments in President Donald Trump’s unprecedented effort to exclude immigrants living in the country illegally from the population totals used to divvy up congressional seats.

In a memo in July, Trump outlined that millions of noncitizens should be excluded from the once-a-decade head count of the U.S. population that determines how many seats each state gets in the House of Representatives. The census also determines the allocation of some federal funding.

The Supreme Court, which has a 6-3 conservative majority including three justices appointed by Trump, met by teleconference Monday to hear arguments in the case. It’s the second case the high court has considered in two years related to the 2020 census and immigrants.

The challengers to Trump’s July directive include various states led by New York, cities, counties and immigrant rights groups. They have argued that the Republican president’s move could leave several million people uncounted and cause California, Texas and New Jersey to lose House seats, which are based on a state’s population count in the decennial census.

Why don’t we just declare the entire world’s population to be
American citizens and Democrats? Save a lot of squabbling down the road.

Since Representatives are elected by citizens, it make a clear argument that only citizens be counted.....
Everyone else has some sort of government attachment elsewhere and an embassy etc to represent them.....

I hope to be wrong, but, I predict a ruling against omitting illegal aliens. And the liberal reasoning will be that, #1, we can’t specifically identify who is here illegally, and #2, people who are here illegally, since they are in fact here, deserve congressional representation. And #3, since the census counts are used for so many purposes, it would be discrimination to pull out non- citizens for this one specific purpose.

Flame away. I hope I am wrong, but I think the above could be the reasoning used to include illegals and all non citizens in the apportionment numbers.

I listened to the SCOTUS hearing last night.

At one point Roberts cut off Alito who was asking six questions to point out the silliness of counting people who are illegally in the USA:

1. Is a person on a 90 day tourist visa counted? Answer NO.
2. Is a person who overstays a 90 day tourist visa counted? Answer YES.

At that point Roberts cut off Alito and went to the next justice.

I believe we all know the reason Roberts cut off Alito. Roberts did not want to have a soundbite the media would use if they had all six questions and answers.

Talk about voter disenfranchisement. Every Congressman a cluster of illegals get, American citizens are deprived of representation in Congress.

I think you're right about the result, but not the reasoning. At the argument, Justice Barrett was hammering the DOJ lawyer on the language of the Constitution, which says apportionment must be based on "the whole number of persons" in each state.

This sounds stupid, but I thought it was illegal to benefit from breaking the law... Like the guy that stole the credit card and bought a winning lottery ticket with it. (Don’t remember how that turned out, but the crook wanted to claim the ticket)... Anyway a case might be made that illegals are breaking the law and the states are benefiting with more reps.

Roberts is perhaps the most protected person in the country. The deepstate owns him. To have a RINO justice, and be able to control every vote, is priceless to the deepstate. They take no chances on his personal safety.

Illegals are stealing power from Americans. Causing some states to be under represented. Also with that power they can push their agenda with their congressmen. Which has always proven detrimental to American citizens.
