Publix slapped with wrongful death suit after Florida employee dies of COVID-19

An employee at a Publix supermarket in Miami-Dade county was allegedly prohibited from wearing a mask at work. Now his family is suing the company over his death.

The coronavirus had already made its way well into the US by the time Gerardo Gutierrez, 70, asked his employer if he’d be permitted to wear a face mask while he worked. Despite the fact that his deli counter colleague was showing signs of the illness as they worked together on March 27 and 28, Publix told him that masks were not allowed because they may “scare” customers, the family’s lawyer has claimed.

I don't know what to think about this. Payday from the courts or did this he said she said really happen? I feel sorry for the gentlemen who passed but does not add up. He choose to work there.

Hard to believe that a store manager would forbid a 70 employee from wearing a mask, when the mask is desired for health reasons.

Proving negligence — that the Covid Cooties were contracted from working there (and from no other source) — would be difficult to prove ... but where there’s a will, there’s a lawyer.

Our Publix is about four blocks from our house so we pretty well grocery shop daily. The workers wear masks and I do believe that is company policy. An exception for health reasons would be feasible but likely they would reassign that person to avoid public contact.

how many customers got sick?

how many other employees?

did they compare their strains?

There is no clinical evidence demonstrating that wearing a mask prevents Wuhan or any other kind of flu.

If masks made any difference why are (false-)positives “surging” when everyone is wearing masks?

Publix might have an issue if they knew the other guy was sick and allowed him to work.

I followed Publix on reddit at the beginning of the China virus since employees are quick to post cases in their stores. There was a lot of moaning about corporate refusing to let workers wear masks, followed by moaning about mandatory masks, followed by more moaning about customers who refuse to wear masks.

I suspect that back in March, since there wasn’t nearly enough masks to go around, they were afraid that if he wore a mask and didn’t get it, but someone else without a mask did get it, they’d get sued for not protecting that person.

Lawyers.

There is NO Science demonstrating a Mask will slow or stop the spread of an influenza type virus, they will LOSE on that issue, but they Allowed a SICK Person to remain on the Job during a Scamdemic, that will Burn them.

So...his co worker in the DELI was SICK...stupid...manager should have sent THAT EMPLOYEE home...wonder how many customers got sick.

Masks are meant to stop people from transmitting infectious respiratory diseases, not protect.

Article indicates this happened in late March. Masks were probably not required/mandatory at that time, like so today.

So, there is no chance that the victim became infected with the virus through other contagion venues?

It’s a FRICKING VIRUS! It is in the wild and literally everywhere there are people and/or surfaces that came in contact with people or became contaminated by surface-surface transmission.

Also, the victim could have already contracted the virus and in-fact became a contagion risk and virulent host that infected others as well! There is no way to prove when and where he contracted the virus.

The lawsuit is frivolous on its face and a complete joke.
