Well, the prosecution claim is that Rittenhouse gave this other person money for the gun.
But I think the claim fails because Rittenhouse did not have possession of the gun before the night in question.
I think if I give you money to buy a gun that you are going to deliver to me that is a straw purchase. If I give you money to buy a gun that you will hold on to and lend to me when I go shooting with you, that is not a clear cut straw purchase. Transfer of ownership never happened.
Crud.
Knowing this younger generation, Rittenhouse probably used an app to transfer the funds for the rifle to his friend, hence the prosecution having something to squeeze the accused with. In my day, we used cash.
“Prosecutors said Kyle Rittenhouse, 17, of Antioch, Illinois, gave Black the money used to buy the gun.”
Prove it, Prosecutor. That’s a hard bar to reach.
Got my hunter safety through the Boy Scouts.
I dont know the answer to this: but did Rittenhouse have the legal standing to possess a firearm in WI?
I know that I cannot allow a minor from Il. without proper certification to use my long rifle in MA.
They would have to have completed a MA firearms course and possess an FID card.
The rifle was kept in Wisconsin.
Rittenhouse could legally possess the rifle in Wisconsin. He was not a prohibited possessor.
This is a way to get a Federal charge against him. That is pretty clear.
Well, that’s not going to help this situation onw, is it?
All by design, Comrade. All. By. Design. :(
***...was not legally able to buy the gun because he was not 18 years old.***
Got my first at 14, and later bought my own at 18. But that was before 1968 and Johnson’s Gun Control Act.
You might have noticed that things have changed in the past 60 years.
” to kill two protesters “
They were rioters, arsonists and looters, in addition to being paroled pedophiles, violent assaulters, and a host of other significant crimes.
Not “peaceful protesters”.
I’ve always wondered how long I have to retain a firearm I bought before I can give or sell it without being a “straw buyer”.
A day? A week? A month? A year?
Great point for his defense team.
Or from the vendor.
How did the firearm make it from the guy who bought it, to Kyle. When did that happen and the circumstances. Did Kyle bring it across state lines?
That would clear things up.
Its not hard at all. The idiot probably sent him a Venmo for the exact amount on the exact day.
I don't believe that the Fed law indicates any length of time that you must own the firearm.
I think as long as it is defensible, and doesn't violate 'probable cause', you are safe from prosecution.
A day? A week? A month? A year?
About 20 years ago, when I had an Federal Firearms License, at an ATF seminar, the ATF agents told us that after a firearm was transferred to our private collection, once it was privately ours for a year, we could sell it as a private sale.
Back then, I thought it was a clear, hard, rule.
But that was for someone who was a Federal Firearms Licensee.
Illinois has reciprocity agreements with its neighbor states regarding firearm acquisition and possession. So long as Rittenhouse had a legal Illinois FOID, I don’t think there would be an issue in this case.
