Judge reviews ballot counting in suburban Philadelphia county

A federal judge in Pennsylvania on Wednesday weighed arguments by Republicans seeking to stop a suburban Philadelphia county from counting mail-in and absentee ballots that voters had been permitted to correct.

U.S. District Judge Timothy Savage in Philadelphia appeared skeptical of arguments by the plaintiffs’ lawyer, which lawyers for Montgomery County election officials and the Democratic National Committee said could disenfranchise voters.

The Pennsylvania lawsuit had been filed by Kathy Barnette, a conservative political commentator projected to lose her race for a House seat in the state’s 4th Congressional district, and Clay Breece, chairman of the Republican Committee in Berks County.

They accused Montgomery County election officials of having illegally “pre-canvassed” ballots for mistakes and allowing voters to correct them, and sought a temporary restraining order blocking them from being counted.

Thomas Breth, a lawyer for the plaintiffs, likened the case to the 2000 election, when the Supreme Court in Bush v. Gore settled a dispute over vote-counting in Florida, enabling Republican George W. Bush to capture the White House.

“It is creating the same situation that Florida created in 2000,” with “all of these different counties treating ballots in non-uniform manners,” he added. “There’s a solid argument that you’re voting twice.”

Savage, however, questioned Breth on the fairness of blocking voters from correcting mistakes on their ballots.

“So what happens to my vote?” the judge asked.

Breth said it could be “potentially disqualified.”

“But I was never given the opportunity” to fix it, Savage responded. “I am losing my vote.”

Election officials countered that there was no equal protection violation, and accused the plaintiffs of filing a last-minute lawsuit to undermine voters’ right to vote.

This is THE lawsuit to watch.....involves election officials in PA suburb Montgomery Cty personally contacting mail-in
voters which arrived w/ defective ballots to give them a chance to fix or “cure” the problem, like a missing signature..............
apparently in violation of state law.......

BACKSTORY A local Republican candidate sued to (A) stop the practice and (B) for the ballots not to be counted,
both on the state law claim, and,

(C) because, (drum roll please) citing Bush v. Gore, in the FLA mess, it’s a "federal equal protection violation" for some voters to be
notified about curing their ballots while not notifying others.

STROLL DOWN MEMORY LANE: The USSC ruled in the Bush/Gore fiasco that it was a violation of the “one man, one vote”
to only partially count and SINCE they couldn't count the whole state of Florida, Gore's partial recount was invalid.
The USSC ordered the count to be stopped.

The decision seemed more like the USSC's acknowledgement of Democrats' proclivities
to count, recount, then count again, till they had the necessary votes to win.

BTW, when the USSC stepped in ......it was due to brilliant legal moves by Bush's lawyer, former Secy of State James Baker.

In his book about losing the election, Gore related that whenever his lawyers got to court,
Bush's lawyers had already been there.....always a a step ahead of them.

That’s republicans for you. Fear of the other guy has been the battle cry for a generation. Trump was the first candidate in a while to rally behind and we had no counter in the media, tech, with minorities, and the education systems for the incessant drumbeat of leftism.

The former red states are the battle grounds, not the blue ones. We’re giving up ground on every front. GA & NC this election, what republican stronghold will topple in 2024? SC, TX?

Another election where the RNC doesn’t do jack shit to try to get some kind of organization in California and New York. I know it’s an uphill battle to win those States, but geez, can we at least make them earn it for once?

These are Dem controlled states.

Trump got the voters to support him, and in states with red govs/legislature he killed it. Look at Florida, a very impressive gain that by all means indicated a landslide victory.

But, we have 5-6 major cities that have generated a gotv plan and voter fraud that is of epic proportion. I’m guessing then that some of these places are going to have 200% registered voter turnout, and while that appears to be prima facie evidence of fraud, it’s happened before and never been investigated/stopped.

I do agree, something has to be done, but it’s not gonna happen. My home state of Washington is so far gone, it’s laughable. Both Oregon and Washington instituted mail only voting, and the Dems have never lost anything since. It’s like living in a 3rd world country as far as elections go.

Until this all ends in massive poverty, then nobody is gonna do shit...

Apparently Team Trump trusted the assurances of the Walker/Priebus machine up in WI that an injunction to stop early-morning mail-in counting wasn’t needed.

And then the 138K Biden vote drop at 4 am gave the state to Biden.

What the (#&*#*#*# was Trump doing trusting that? It feels like he learned nothing out of the four years of insider GOPe/Never Trumper backstabbing within his own friggin’ team!

I had a dem poll watcher with me here in FL. She bragged about attempting cures on ballots for both parties. That was of a load of crap and I wondered why she was making a point of it. Now I understand that.

The judge says, “So what happens to my vote?” That should not even be a part of the consideration. The only consideration should be was the law that the legislature pass followed. This is the philosophy ACB has. It is not the job of the judge to provide equity; the judge’s job is to make a ruling according to the text of the law.

That's exactly right. When the judge asked why his ballot should be disqualified just because he didn't have an opportunity to correct it, the answer should have been: "Because the measures taken to fix or cure the defects in your ballot are illegal under state law, and there are 66 other counties in this state where the voters DIDN'T get a chance to fix or cure the defects in their ballots because the election officials obeyed the law and didn't contact them."

Can someone do a map of voting by county. It was enlightening last election observing how few counties voted for Hillary.
