The Supreme Court late Wednesday ruled to allow absentee ballots received up to nine days after Election Day on Nov. 3 to be counted in North Carolina.
In what is regarded as a victory for Democrats, the 5-3 ruling means that the North Carolinas Board of Elections decision to stretch the period from three to nine days for absentee ballot counting will stay. The ballots will counted as long as they are postmarked by Election Day.

The latest Supreme Court decision comes after the 4th Circuit Court of Appeals ruled on Oct. 20 to uphold a deadline extension in the state for the receipt and counting of absentee ballots to nine days from three.
The Democratic-majority State Board of Elections decision to stretch the deadline to nine days was part of a legal settlement with a union-affiliated groupthe North Carolina Alliance for Retired Americansin late September. The legal settlement also loosened requirements for fixing absentee ballots that lacked a witness signature. The settlement said counties should have longer to accept ballots because of possible mail delays.
North Carolina Republicans earlier on Wednesday requested for the second time that the Supreme Court block the extended deadline. They sought to reinstate the three-day extension that North Carolina had set last June. Their petition (pdf) cited concurrences filed by Justices Brett Kavanaugh and Neil Gorsuch on Monday, when the court ruled against extending a deadline for absentee ballots in Wisconsin.
President Donald Trumps campaign had filed a separate but similar appeal to the Supreme Court to block the extended deadline.

By far the best post I have read on this topic, thank you. It drives me up the wall how many so-called conservatives have let themselves be conned into accepting Judicial Supremecy, particularly the horrifying notion that the Supreme Court’s rulings could ever take precedence over laws passed by state legislators on that state’s election matters.
I have no problem with that. Who will be checking the postmarks on all late ballots?

NC case was 5-3, so both Kavanaugh and Roberts went to the dark side on that one. Barretts vote wouldnt have made a difference. Hope it isnt a sign of things to come. Kavanaugh is a bit squishy unfortunately.

You ignore the good number of corrupt union postal employees who will be running ballots through a cancelling machine AFTER Election Day but with a cancellation date of 11/3/2020 or earlier.
North Carolina actually count mail-in votes 2 weeks before Election Day. The RATS have a very good idea of how many votes they need to manufacture.

I would like to agree with you, but in a war it’s the enemy who sets the terms of engagement, and the enemy’s terms is to use Federal Courts to stymie anything good for America, so that is the battlefield where we are compelled to drop our legal ordnance.
That’s what they don’t know. How many ballets they need.

Sure, but in a war it’s the victor who decides the terms of their enemy’s surrender. Trump’s entire first term has been plagued with rogue Federal Judges making illegitimate rulings contrary to his policies and the law. By failing to reject these illegitimate rulings outright and rather depending on the Supreme Court to settle everything we have in effect agreed to our terms of surrender in advance.
It’s possible in both N.C. and Pennsylvania that Republican legislators will ultimately exercise their right to reject a fraudulent popular vote and determine which electors will be selected directly. If they do this the Supreme Court will have absolutely no authority in the matter, unless our side one again cedes it to them.
A settlement agreement between Democrats and other Democrats to rig the election.
