The Supreme Court late Wednesday ruled to allow absentee ballots received up to nine days after Election Day on Nov. 3 to be counted in North Carolina.

In what is regarded as a victory for Democrats, the 5-3 ruling means that the North Carolina’s Board of Elections decision to stretch the period from three to nine days for absentee ballot counting will stay. The ballots will counted as long as they are postmarked by Election Day.

The latest Supreme Court decision comes after the 4th Circuit Court of Appeals ruled on Oct. 20 to uphold a deadline extension in the state for the receipt and counting of absentee ballots to nine days from three.

The Democratic-majority State Board of Elections’ decision to stretch the deadline to nine days was part of a legal settlement with a union-affiliated group—the North Carolina Alliance for Retired Americans—in late September. The legal settlement also loosened requirements for fixing absentee ballots that lacked a witness signature. The settlement said counties should have longer to accept ballots because of possible mail delays.

North Carolina Republicans earlier on Wednesday requested for the second time that the Supreme Court block the extended deadline. They sought to reinstate the three-day extension that North Carolina had set last June. Their petition (pdf) cited concurrences filed by Justices Brett Kavanaugh and Neil Gorsuch on Monday, when the court ruled against extending a deadline for absentee ballots in Wisconsin.

President Donald Trump’s campaign had filed a separate but similar appeal to the Supreme Court to block the extended deadline.

Do those ballots have to be postmarked on or before Nov. 3?

They have ways of checking for that. The IRS does it.

Certainly something as important a matter as mail-in ballots can be checked for non-compliance to the law--assuming that the law does not allow voting beyond election day.

They plan once again to deny an election night victory to the Republican candidate. They haven’t conceded on election night since the 1980s.

They have a scheme planned for sure. That’s probably they aren’t hitting their numbers. They are holding them somewhere to make sure no one can analyze the data and push voter turnout based on what’s already out. Crooked

NC allowed requests for ballots through Oct. 27. At least some portion of those will not arrive to the recipient before Nov. 3. This is a recipe for disaster.

North Carolina Republican and Trump voters need to wrangle voter to the polls by Saturday, get absentee ballots in, and then hustle until Tuesday. If the lead is huge they can’t steal it.

The correct decision would be that North Carolina’s Board of Elections is authorized to decide how they count their ballots but ultimately the NC Legislature can take that authority from them.

I agree it’s bad.

It’s also bad to go running to a Federal court to interfere in the internal, sovereign affairs of a State - one of which is the appointment of Electors.

If a State Court defies the rules a Legislature has set for the appointment of Electors, they should be defied. In the extreme, the Legislature should appoint their Electors directly.

What should NOT happen is to open up the process of appointing Electors to ANY BRANCH of the Government at Washington. That government was DELIBERATELY excluded from having a role in the appointment of Electors and of their election of the President and Vice President.

Now, why do you suppose they did it that way?
