Every state has the authority to develop their won election laws, without interference, unless they violate the constitution.

An extension of the timeline to count their ballots is wholly within the purview of every state.

The only thing Zero had on Roberts, in my view, is an X-ray showing that Roberts has the backbone of a chocolate eclair (to borrow a well-known T. Roosevelt quote).

She was seated. She recused herself without officially saying it.

Per the Public Information Office: “Justice Barrett did not participate in the consideration of this motion because of the need for a prompt resolution of it and because she has not had time to fully review the parties’ filings.”

SCOTUS did not agree to hearing the case on an expedited schedule is all.

This ruling said this case may NOT escape review (and ruling) on a lesser of an emergency scheduling.

Not a loss. An improper filing for immediacy from SCOTUS taking the case.

However, if the election involves the presidential race, then any changes to how that election is run, including extending the timeline for accepting and counting ballots, must come from the legislature, not the courts. The legislature is given sole authority for determining how the electors are chosen, and if a court mandates a change to that process, it would be in violation of the US Constitution. Not just my opinion, but also the thinking of Kavanaugh in his opinion on the Wisconsin case.

The PA Legislature did not extend the deadline. Our corrupt state supreme court did.

My theory is that John Roberts is being blackmailed. He did something in his past which he cannot afford to be leaked out. Some Dem operative has that info, and his feet are being held to the fire on issues key to the Dems. As I recall, his ruling on Obamacare was the first visible sign that something was wrong. Either that or he has turned out to be as fake as Christopher Wray.

“Alito wrote that it would be “highly desirable” to decide the case before the election and that there is a “strong likelihood” that the Pennsylvania Supreme Court ruling violates the Constitution.

“But I reluctantly conclude that there is simply not enough time at this late date to decide the question before the election,” he wrote.

In addition to an expedited schedule, Republicans had asked the Supreme Court to order Pennsylvania to keep ballots that are received after Nov. 3 separated. Pennsylvania told the justices earlier on Wednesday that it will do so voluntarily.

Alito wrote that nothing prevented the GOP from asking the Supreme Court for relief “if, for some reason, it is not satisfied” with the assurance provided by the state.”

The Gop should seek relief that PA must separate the ballots that come in after Nove 3rd not just voluntarily. Alito is saying this I think

No they didn’t. All the hysterics here can go back to your meds.

They said they would review it later. PA agreed to sequester ALL ballots received after 11/3. This is a huge win. It gives the court time, with ACB, to review in and bring it up again with being damaged by the late ballots.

My court guy, Zen Master, is fine with this ruling and has never been wrong.

Not a ruling on the merits of the case, but only for expedited review. Ballots returned after Nov 3 will be segregated, so basically any ballots that arrive after Nov 3rd are in jeapardy of being tossed, pending a final ruling by SCOTUS.
