“””””The Fourth Amendment to the United States Constitution requires that the police, before they enter your home with a search warrant or an arrest warrant for that matter, knock and announce themselves,” said Ago. “That’s the rule that’s the requirement.” “””””””””

That’s what the cops did.
it was very impolite of the drug dealer inside to shoot at them.

“”””””” No-knock warrants have been the subject of many questions we’ve received at WUSA9 following the murder of Breonna Taylor by Louisville police. “”””””””””

The grand jury said nobody was murdered. A drug dealer got killed when her boyfriend shot at cops and they returned fire.

There is no journalism in this country anymore.

A grand jury said Jake Gardner is a murderer and terrorist. You believe that?

>>he Fourth Amendment to the United States Constitution requires that the police, before they enter your home with a search warrant or an arrest warrant for that matter, knock and announce themselves,” said Ago. “That’s the rule that’s the requirement<<

Hmmm...

Amendment IV to the Constitution of the United States of America:

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Not a big fan of no-knock but not a word in there about announcing.

If one wishes to refer to the Bill Of Rights, one should read it accordingly FIRST.

I know that nobody was murdered in the Breanna Taylor deal.

The cops had a warrant to search her car and her apartment.

They knocked and identified themselves.

Her drug dealer boyfriend shot at the cops and she was killed in the crossfire.

Nobody was murdered.

I haven’t commented on other unrelated cases. I have said the story written by this author is fiction, not fact.

“not a word in there about announcing.”

Not a word about pantsing you and tossing you on a bus either.

I believe No-Knock entry needs to be available to LEO in cases where it is needed.

If you are entering a place with a felon or known criminal who is known to have used weapons violently against either police or citizens, they should have the option.

Does it need to be better monitored, controlled, and executed?

Yes.

But outlawing them puts police at risk.

We need to ask ourselves the question: if I were carrying out this raid myself, or a loved one was carrying it out, and they are looking for a known violent criminal who has a history of murder or shooting police, is announcing myself inviting bullets through the door?

'Her drug dealer boyfriend shot at the cops and she was killed in the crossfire.'

There is no indication that the 'legal' gunowner was a drug dealer. Seems you are trying the slander the dude.

The fourth says nothing of knocking and announcing. What is does say is we are to be free of UNREASONABLE searches. Breaking down the door to someones home in the middle of the night announced or otherwise is the very definition of unreasonable. The results speak for themselves. The is no compelling reason to use forcible entry to serve a search warrant. The police should be required to knock and get a response from the occupants, if no response is received they wait, period no exceptions. If this were followed (ie, a reasonable search) this women would be alive. Also keep in mind this is NOT an isolated incident. This happens all the time and police officers have been killed by people defending themselves.

Do you have a point?

What is the compelling reason we must continue to allow unreasonable forcible entry into peoples homes?

Go ahead and tell us all what justifies this risk?

“unreasonable forcible entry into peoples homes?”

Although not quite a no-knock warrant, this is an example of searches that cross the line for me.

https://www.nationalreview.com/2015/04/wisonsins-shame-i-thought-it-was-home-invasion-david-french/

This was 100% political, excessive, and used legal “features” that abridged freedom of speech. This is the kind of search that should never be allowed.

Why would a warrant be required for entering the Dept of Motor Vehicles?

"We need to ask ourselves the question: if I were carrying out this raid myself, or a loved one was carrying it out, and they are looking for a known violent criminal who has a history of murder or shooting police, is announcing myself inviting bullets through the door?"

No the question we need to ask is why are we carrying out a raid in the first place? Arrest on the street, coming or going from the home or announce and wait for them to respond and come out. The answer is again there is no compelling reason to use raids to arrest drug dealers and for many many reasons. First and foremost is this puts both police officers and innocent people in great peril for little if any benefit. Often the cops are just plain wrong and the occupants of the home are not drug dealers and pose no immediate threat to anyone. Sometimes the police have the WRONG ADDRESS and they put themselves and completely innocent people at risk of being killed. What makes this worse is if they have the wrong address and break down the door at 2am any armed citizen is VERY likely to fire on the intruders believing a home invasion is taking place. Normal folks, just never expect the police to be the ones breaking down their door and thus have only fractions of a second to take action.

Folks, this stuff is really a no brainer. We don't need police conducting a war on drugs. Forcible entry into homes is a third world police state tactic and we need to put a stop to it. Police state behavior has no place in our Republic.

Knock knock. This is the police. We have a search warrant. Please let us in whenever you get done flushing all the heroin down the toilet. Thanks.
