Republicans on Monday asked the Supreme Court to halt a major Pennsylvania state court ruling that extended the due date for mail ballots in the key battleground, teeing up the first test for the high court since the death of its liberal leader Justice Ruth Bader Ginsburg.
The filing comes after the Pennsylvania Supreme Court ruled against the GOP in an election lawsuit that could help shape the race between President Trump and Democratic nominee Joe Biden in the Keystone State, which the president won by just over 44,000 votes in 2016.
The Pennsylvania courts decision earlier this month requires election officials to accept ballots postmarked by Election Day, as long as they arrive within three days. The ruling was seen as a win for Democrats, since Biden voters are more likely than Trump supporters to vote by mail in November.
In their Monday filing, top officials from Pennsylvanias GOP-held legislature asked the U.S. Supreme Court to pause the ruling while they formally appeal to the justices.
In the middle of an ongoing election, the Supreme Court of Pennsylvania has altered the rules of the election and extended the 2020 General Election beyond the 'Time' established by the state legislature, they wrote. In doing so, the Supreme Court of Pennsylvania has violated federal law and the federal Constitution.
The Republican Party of Pennsylvania filed a similar request to the Supreme Court later Monday afternoon.
The filings come less than two weeks after Ginsburgs death from cancer injected further uncertainty into a chaotic 2020 presidential contest that is on track to be the most intensely litigated election in U.S. history. Legal experts say the case is quickly shaping up to be the first big test for the eight-member Supreme Court.

The Pennsylvania Democrat Supreme Court violated the Pennsylvania Constitution in 2018 when it illegally implemented its hyper-partisan Democrat redistricting map which cost the Republicans several House seats in 2018 and may easily cost a couple more this time around.
That was appealed to the U.S. Supreme Court too. Which chose not to rule, and called it a “state matter”, IIRC.
Of course we can be certain things will be different this time.... oh wait.

I don't believe that's going to be the case in 2020 since Trump voters are older than Biden voters. and are more likely to be coronaphobic. The three days does give three additional days for shenanigans in Philly, however.
Graham will not make this a high priority nor will he change the date.
redistricting can be viewed as a state matter as the legislature could have changed the way the electors for pres were selected. This ruling is specific to article II where the court changed the rules the legislators determined to select presidential electors. other district court. WI i think, have ruled against changing the rules by court order.
It doesn’t take a psychic to predict how Justice Roberts will vote.
As Ive often said in this forum, jailing judges for their decisions is barred by judicial immunity. According to the laws of the particular jurisdiction, vote no in the retention election, recall them, or impeach them. Period. There is no other recourse provided for under the law.
Votes counted after election day is rigging no other name exists for it.

For those not following the details, the Pennsylvania Supreme Court usurped the legislature’s constitutional authority to set election rules. Simple as that.
