Snuck into the guidance on the Employment-Based Green Card category in the Oct. 2020 Visa Bulletin from the Department of State was a chart which indicated any H-1B national from India who had been sponsored for an EB-3 Green Card before January 1, 2015, would now be able to file for an EAD work permit (Advanced Parole).
In the September 2020 Visa Bulletin, that date was February 1, 2010. That is a five-year jump!!!!
That means there's a possibility of more than a 100,000 Indians getting EAD cards along with their spouses and children!
In the past, it was often the case that the State Department would release the Early Filing chart, but USCIS wouldn't necessarily adhere to it, preferring instead to only publish the FINAL ACTION chart. This chart would only be in the instance new Green Cards became available for those waiting in the backlog to now be able to file for adjusting their status based on their priority date.
In short, in the past USCIS would inform folks who are in the backlog that they aren't issuing EADs to those backloggers. The fact that USCIS updated their website last Thursday to also include the Early Filing chart is informing people that they are accepting applications for EAD permits now!
This is a disaster!
The immigration lawyers and the H-1B Indian nationals are celebrating! This is essentially opening up the floodgates that will invite more eager people to come on H-1Bs and try their luck at getting EADs!
The White House or USCIS can choose to stop this Green Card Lite program. It's time to make some calls and send some emails!
The White House can instruct USCIS to stop this. Without meaningful reform of the H-1B and /L-1, we are moving into very dangerous territory. This means more harm to American workers.
Below is suggested wording to contact USCIS and the White House.

My point is that American management hate their IT departments. And they are expensive. We are bring Indians over because they are cheaper and more “slave like”. And are perceived as a better option. Not because they are technically superior. This puts thousands of Americans out of work and makes Bezos and Zuckerburg an extra billion or two.
