Michigan Supreme Court is Majority Republican. They should overturn this out of control Judge. November 3 is ELECTION day. VOTERS deserve to know who won on that day.
Let’s not panic. The Michigan ruling requires ballots be post-marked by the day before Election Day. Unlike California, voters still need to request absentee ballots, so ballot harvesting will be difficult. Pennsylvania explicitly forbade all 3rd-party collection of ballots.
They should, but I bet they wont.
Ha ha ha!!! Are you kidding?! Roberts is likely to lean as far over his feet as he possibly can, so as to get a firmer grip on his ankles.
I agree with Mark Levin.
There will be blood neck high in the streets if the DNC really does (as it clearly is planning to do) steal the election
Lord please we don’t want to have America go through that!!!
Rut rho
Bttt
They have Dem governors that will just veto the bills.
Unfortunately the plans now need to be to defeat them at their own game.
Roberts is likely to lean towards the Constitutional position, along with the other conservatives.
***********************************
I wouldnt bet the farm on that.
Roberts is likely to take the path of least resistance. In this case, of course, that would be voting with the leftists on the court.
Anyone with a postage meter can postmark back in time.
Its a super easy thing to do.
Roberts is a full on Lib there is NO WAY Roberts can be counted on for a damn thing, ANY justice that voted for Ocare is NOT even a little bit conservative NEVER HAS BEEN!! Unfortunately we were all conned by Bush the gift that keeps on giving!! Does ANYONE here think that McCain was a conservative Roberts is McCain on the SCOTUS get used to it and for Gods sake ACCEPT IT!!{
Did the legislature grant her emergency powers due to covid would that allow her to veto?
Re: no input from the governor
Great post, A.C.
I had no idea that was in the Constitution.
That is the kind of essential information we used to see every day on Free Republic.
Does the Constitution say Election Day?
Or does it say Election Week or Election Days?
How flexible is “Election Day” in the Constitution?
It's not about the contents of the ruling, it's about how Article II Section 1 says "Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors..."
There is no role for the courts to play in interpreting what the legislature passes regarding the appointment of Electors, so we shouldn't let them sneak in a precedent to grab that power.
I can see the liberals arguing that the legislature is bound by the state's election procedures which the courts can review, but the response is that the legislatures can pass a bill requiring a separate ballot for Presidential Electors to keep them distinct from the other state races. Let the other races have mail-in ballots arriving up to two weeks later, but the Presidential ballot must be received by Election Day.
If I were a legislator in such a state, I'd pass a bill saying that if your ballot is received after Election Day, the Presidential vote will be void and only the down-ticket votes will count.

How flexible is Election Day in the Constitution?
From Article II Section I of the Constitution:
The Congress may determine the Time of choosing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.
Looks like it specifies a specific day. The notion of allowing votes to be cast after election day is something akin to a 3rd world banana republic, but these are the lengths that the left will go to in order to drag biden's carcass across the finish line.
It would be nice to have some representatives with some backbone on our side to fight this.
All the swing states have democrat governors except Florida. It will be the state courts like Wisconsin and PA that will decide this election.
Message to Mr Levin: Don’t hold your breath.
