California Gov. Newsom Signs Critical AB5 Exemption For Music Makers Into Law (good news in CA for a change)

Ever since the initial passage of California's Assembly Bill 5 (AB5) back in September 2019, the Recording Academy has been fighting for a much-needed amendment to exempt music makers from the bill's sweeping intentions to regulate gig-economy workers.. At its annual Entertainment Law Initiative back in January, the Academy discussed the issue during a panel and has continued to work with music industry stakeholders to press for the correction.

At long last, the amendment exempting the music community from the unintended consequences of AB5 was officially signed into law by California Governor Gavin Newsom on Sept. 4. This came just three days after unanimously passing both the Assembly and the Senate on Sept. 1. The update to AB5 ensures that music professionals won’t have to deal with the added costs for compliance, accounting practices, and new business expenses such as payroll processing that, while intended to benefit independent contractors working for large tech companies, created havoc for music makers and the studios and venues who hire them.

This is good news for the impacted people.

It's also a great example of how stupid government can be. AB5 shouldn't have been passed in the first place.

This law directly impacted me as an independent contractor in the transcription industry. When this passed the tiny California transcription company I worked for immediately transferred all work to her out of state transcribers. Not only can she not afford the costs of employing people, nobody would do it. We're transcribers because we want to WORK FROM HOME and set our own hours.

No matter. Moving to Tennessee in December and bringing my tax dollars and conservative vote with me.

I think AB5 is one of the most loathsome pieces of legislation recently enacted in the US. It includes almost all the ingredients behind why many people turn away from liberalism/thinking the govt can "help."

Government thinks it knows best and passes a "pro-employee" law that screws the very people they want to help, and of course there were exclusions in the first place for "protected" sectors.

Then the legislature and executive reverse parts of the law and look like heros.

FWIW, AB5's chief instigator, Assemblywoman Gonzales, is a particurlty disgusting pol - "I’m sorry you feel that way. This is not a bad bill. Without it there would be no ability to freelancers to work under Dynamex. Also, thousands of workers would not have the protections they need. You want changes, that doesn’t mean the bill is bad."

Certainly. The theory is that employers can "get away with" not paying workers' healthcare and other benefits if the workers are "freelancers" or "contractors" as is the case with Uber and Lyft. So, under AB5, freelancers and contractors located in CA must be made full-time workers by the companies or else the company gets fined, etc.

Sounds great in theory, right? However, in many cases, such workers CHOOSE this way of working and it's not like they're being screwed. Everyone was happy, except a few unions et al.

In practice, California employers dropped all such workers rather than hire them. Instead, many companies moved freelance or contract work to people outside of California, since CA-based workers were now financial Kryptonite. In-state freelancers' income streams dried up

My boss has a California Contractors license. The State decided that they wanted prepayment of taxes for all employees on contracting jobs quarterly. When he informed them that he cannot prepay or estimate earnings on jobs that he does not have yet, they made him sign paperwork stating he would hire no California’s for work.

As a result our company has people from any state but California.

Just another example of the Democraps “fixing” the non union workers for the Unions.

I think you are right that Prop 22 only covers ride share drivers and maybe food deliveriy services and I support Prop 22 but it still leaves many others stranded!

AB-5 should be flat out nuked because it is a perfect illustration of the fallacy of the idea that government is your friend and here to help you. Government people think you all should be slaves to your rulers because you should be totally controlled by them in ALL aspects of your existence with NO exceptions whatsoever!!!

They reject the old concept of "Public Servants!" You serve them!! They don't serve you rugged individuals out there!!!

This Exemption is what one would call “tossing a bone”. Biden has said he wants to take AB5 nationwide. One of the many surprise gifts that the nation is going get if MSM get the rats into the White House.
