The charge would not be theft, but destruction of property. It doesn’t belong to them. They can’t shred their documents on the way out the door.

When I returned my company phone to my last employer the company IT guy wiped it clean and “reset” it. I can’t imagine he would have done that if it violated any kind of company protocol ... and it certainly couldn’t have been illegal on my part.
