A federal court ruled on Thursday that President Trump's order to exclude undocumented immigrants from census numbers for apportioning congressional districts is unlawful.
A unanimous three-judge panel for the U.S. District Court for the Southern District of New York said in its decision that Trump's executive memorandum violates the executive branch's "constitutional responsibility to count the whole number of persons in each State and to apportion members of the House of Representatives among the States according to their respective numbers."
The ruling prohibits the Department of Commerce from reporting any information regarding undocumented immigrants in its census count that could be used to implement the president's directive.

Why should illegals count towards apportionment?
So people here illegally that could be removed must count as part of the population? Tourists? Who else?

Sorry, the Supreme Court, upholding Obama’s executive decree concerning DACA, has already ruled that the President of the United States has the authority to determine immigration entitlements.
This will be challenged in a higher court. NY court has no right to decide matters of national import.

It’s about time we got over this notion that the Judicial branch is supreme over all others and can make laws and dictate immigration policy to the Executive branch.
In a few months we might have the Judicial branch attempt to tell us who won the Presidential election. Now would be a good time to give some consideration to the meaning of the term “Checks and Balances”.

Where on the 2020 Census Form does it ask if a person living in the household is a U.S. citizen?
If it does not ask if a member of the household is a citizen, how can the census exclude persons that are in the country illegally?
