Californias legislature passed a bill late Monday granting renters who are financially affected by the Covid-19 pandemic a reprieve from evictions, which were set to resume Wednesday when prior relief expires.
The bill passed with supermajorities in both houses of the Democratic-controlled legislature in the final hours of its two-year legislative session and addresses what advocates had said was a looming wave of evictions. Democratic Gov. Gavin Newsom, who crafted the compromise with legislative leaders, tenant advocates and landlord groups last week, immediately signed the bill into law. It takes effect immediately.
Backers say it will help keep Californias 17 million renters housed as the states economy remains largely closed during the pandemic. The measure would forestall until Feb. 1 evictions for tenants who declare that they have lost income due to the impact of Covid-19 on the economy.
All back rent owed by the tenant from March 1 through Aug. 31 of this year would be converted to consumer debt and couldnt be used as grounds for eviction. To receive continued protection, a tenant would have to pay at least 25% of their cumulative rent between Sep. 1 and Jan. 31. The remaining balance would also become consumer debt, which landlords could pursue in small-claims court starting March 1 of next year.
Even the bills strongest supporters said it was only a stopgap that leaves tenants treading water financially unless and until the federal government provides additional stimulus funds to keep families and landlords afloat.
Eviction relief was one of the most hotly contested issues in the statehouse during the final weeks of the legislative session, which was even more chaotic than usual due to the coronavirus pandemic.

Sucks to be a landlord.
A lot of real estate investors are going to find out the hard way how much it sucks to do business in California. There is going to be a tsunami of foreclosures of rental properties in California. And if history is any lesson, President Trump will be blamed for it all.
I believe "unless the tenant had a good reason such as needing meth lab income and the other tenant dissed him once" are considered legal precedents for quick dismissal. That Judge Nap guy probably can quote the law.

They have no right to do that. This in an illegal action. The government does not have the right to invalidate a legal contract.
This is one the most evil things ever done in the USA. Lets say a landlord has one or two properties and it is their only income. Lets say they make $1000 a month or less. From that they have to pay the taxes, insurance, repairs on the rental. Plus their own living expenses. Now lets say that even one tenant stops paying. At that the point the landlord can’t even afford to pay the expenses on the rentals let alone there own living expenses.
Forcing such a landlord to pay for that tenants housing is immoral and evil. It is even worse than communism. In the USA it should be as illegal as anything could be. Many such landlords are going to end up homeless themselves. And while they are living under a bridge then they may still be responsible for the tenant.

And let me tell you about judgements. It costs a ton to even try to get one and have it processed. It is usually impossible to ever recover the money. Some states have written the laws to make sure of that.
Yep! I know people who rent out homes they bought years ago (and lived in for ages) and use the money as their primary income during retirement. I also know a guy who owned 3 rental homes in California, all bought fairly low and that he fixed up himself.
Now they won’t be able to collect the rent. Does ANYONE believe California will excuse the property tax? Does anyone think the bank won’t repossess a home where the landlord has been unable to make payments because HE isn’t able to collect them?
I’m SOOOO glad I don’t own rental homes and that I have no business dealings with anything in California!
I am not a lawyer, but I don’t see how this is Constitutional.
5th Amendment “...nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”
And don’t forget if there is a lease, then there is a contract involved. Can the legislature simply void contracts?
I am lucky, no missed rents from my units.
The trick, learned after many years is to wait until you have found quality renters.
It helps that I am willing to keep them empty while waiting for the ‘correct fit’.

And the landlords/banks will be left holding the bag.
Banks will get a bailout. Not landlords who lose everything.
And imagine if every grocery store had to let people load up there carts and leave without paying. Imagine if the grocery stores could do nothing more than create a list with the sum total of groceries that left the store for a given person. Now imagine if the only way that the grocery store could try to recoop that money is to take all of the “Customers” to court. Get a judgement.. And so on. But the grocery stores could not even do that until the democrats decide it is ok. How long before the grocery stores have to shut down? This is much like what they are doing to the landlords only you have to take it one step further than that to equate with the landlord situation.
When the grocery store goes bankrupt and shuts down then you need to pass a law saying that they still have to provide groceries to anyone who wants them. Make them legally liable to do so.
Pure evil.

If I die and got to hell, I’ll be a landlord. I’d burn my GD apartments to the ground before I would let this happen.
People starting new businesses should remember that markets can change in extreme, new ways.
