Virginia State Sen. Louise Lucas (D), who serves as Senate Pro Tempore, has been charged with felony conspiracy and other charges in an incident where she, along with other conspirators, allegedly damaged a Confederate statue in Portsmouth that also resulted in serious injuries to a protester.
Sen. Louise Lucas faces charges of conspiracy to commit a felony and injury to a monument in excess of $1,000, Portsmouth Police Chief Angela Greene said during a news conference, says Politico.
The protester, Chris Green, was critically injured at the scene and is currently under care at a rehabilitation center with permanent injuries. The incident happened in June.
Greene said the independent investigation started after several requests were made to look into the circumstances that led to the destruction of the monument and Greens injury, reports 13NewsNow.
Its deeply troubling that on the verge of Virginia passing long-overdue police reform, says Virginia Gov. Ralph Northam via Twitter, the first Black woman to serve as our Senate Pro Tempore is suddenly facing highly unusual charges.

I especially like how someone says, with a straight face, that having the unaffiliated, hired police file charges, instead of the elected, political, local prosecutor, was somehow “political”.
Fortunately, in Virginia, the police can bypass the elected AGs, who clearly are put in place to protect the crimes committed by their party.
On the other hand, I don’t know how you actually get a conviction if the prosecutor is not willing to make a case.
It is clear they HAD to file charges, because not only were these protesters destroying public property (which all too often gets ignored), in the act of committing that crime, they actually seriously and permanently injured a person.
This legislator was actively encouraging people to tear down the statue, in violation of law, and in doing that, she nearly got someone killed.
And the democrats want her to go free, because a real human life is worthless to them, compared to a vote in the Senate.

Anyone familiar with Virginia law: 1) Can the police procure an arrest warrant without the consent of the Commonwealth Attorney? 2) If the Commonwealth Attorney refuses to prosecute, what happens?

Typically, legislators are not subject to arrest during legislative sessions, unless, as in this case, a felony or other serious crime has been charged.
