Is Kamala Harris a natural born citizen?

Harris is constitutionally ineligible to be VPOTUS (12th Amendment) or POTUS (Article 2). She is not — nor can she ever be — a natural born citizen...

Harris was born in Oakland, California on October 20, 1964, to an Indian citizen mother and a Jamaican citizen father. Thus, Harris is a native-born American citizen, or a citizen pursuant to what I refer to as the anchor baby provision of the 14th Amendment.

Harris may be a native-born American citizen by the accident of her birth and in my opinion an erroneous 14th Amendment interpretation, but she is also a citizen of Jamaica.

Under Chapter 2 of the Constitution of Jamaica, a person born in Jamaica after August 5, 1962, or born outside Jamaica after that date to a parent who is a Jamaican citizen, is automatically considered a Jamaican citizen at birth. Furthermore, under current Jamaican legislation, citizens of Jamaica can hold multiple nationalities. And this status does not prohibit serving in the legislature of Jamaica!

Harris was born Oct. 20, 1964, and her father was a citizen of Jamaica at the time of her birth. Therefore, the law of Jamaica is clear: Kamala Harris is a citizen of Jamaica, pursuant to Section 3Cb of the Constitution of Jamaica.

And what about citizenship of India? Harris's mother was a citizen of India and, to the best of my knowledge, never actually became an American citizen.

Well if Trump tweets something about this, it will become big news.

Trump is the son of an immigrant and four of his five children would be disqualified from presidential eligibility using the same standard that is being applied here to Kamala Harris.

Does President Trump believe his own children are ineligible? I would bet he does not believe this.

230 year old piece of paper ain’t going to change that in a society in full collapse. The only thing that can change that is men under arms.

Agreed. This is the worse choice that Biden could have made. So many legitimate things to go after her on. This argument regarding eligibility will go nowhere and take up way too much time in discussion and fighting. Better to spend our time on things that will make a difference and that is to go after her politics. Eligibility is not a hill worth dying on.

Give John Roberts an opportunity to issue a fanciful ruling out of his own imagination and declare her natural born. If there's a lawsuit and it makes its way to SCOTUS, I would expect him to invent something.

Let me phrase the question another way. If Kamala Harris was indeed quite ineligible to be Joe Biden's VP pick, would most republicans forcefully object to a violation of the constitution? We already know the answer to that, the the question is moot.

This article postulates a legal opinion that is not the current accepted doctrine. The logic of the current doctrine:

The constitution is the supreme document of the land

It enumerates the power of Congress (Article 1, Section 8, clause 4) the exclusive authority to establish all rules regarding immigration and naturalization. That includes rules for those that require naturalization in order to become a citizen. And those that by the circumstances of birth, are citizens at and from birth i.e. they are natural born, a citizen

Congress expressed it’s rules of naturalization in title 8 section 1401 of the US code

Subsection A specifically incorporates the verbiage of Section 1 of the 14th Amendment.

In 1898, subsequent to the passing of the 14th amendment, SCOTUS ruled in the case of US vs Wong Kim Ark, that even though he was born to foreign parents, he was born within the US and by function of his birth circumstances, is/was a citizen at birth.

Similar to that case, Mr Harris is born in the US to non-US citizens. In many ways, her case is nearly identical to to the Wong Kim Ark case.

That is the state if the current legal interpretation. If you disagree with that interpretation, work to elect those in congress who will change the laws.

There are only two categories of citizens - those that have been naturalized (became a citizen) and those that are born a citizen. There is no other category.

Trump did not mention this in his reaction. With Roberts as Chief Justice he knows it is pointless to pursue it.

Cruz wasn’t even born here, which seems to be the criteria that the anti-Constitutionalists have settled on.

He has a file somewhere that contains the paperwork that describes how and when he got his citizenship, all children born abroad do, we need to see it.

What is the PREVAILING definition of a Natural Born Citizen? I don’t mean what does it really mean, but how has it been defined by, say, SCOTUS? There’s the answer.

Barry Soetoro was allowed to be president so KH should have no problem unless the idea was to get Pelosi as the Dems next Prezzy because Joe will never make it 4 years in office.
