A federal appeals court Friday threw out Dzhokhar Tsarnaevs death sentence in the 2013 Boston Marathon bombing, saying the judge who oversaw the case did not adequately screen jurors for potential biases.
A three-judge panel of the 1st U.S. Circuit Court of Appeals ordered a new penalty-phase trial on whether the 27-year-old Tsarnaev should be executed for the attack that killed three people and wounded more than 260 others.
But make no mistake: Dzhokhar will spend his remaining days locked up in prison, with the only matter remaining being whether he will die by execution, Judge O. Rogeriee Thompson wrote in the ruling, more than six months after arguments were heard in the case.
An attorney for Tsarnaev said they are grateful for the courts straightforward and fair decision: if the government wishes to put someone to death, it must make its case to a fairly selected jury that is provided all relevant information.
"It is now up to the government to determine whether to put the victims and Boston through a second trial, or to allow closure to this terrible tragedy by permitting a sentence of life without the possibility of release, David Patton said in an email.

It’s cheaper to let these idiots sit in prison for the rest of their lives - rather than the lengthy court appeals up until their death...

It’s not a matter of fact whether he did this — HE DID — WE ALL KNOW HE DID -— the point of his court case is that - were the rules of laws and investigation followed — should have nothing to do with jurors at this point — it was an act of terrorism/war.
Being judged by his peers should not apply in this case - he should have stood against a military court - not a civilian.
The whole way he gained US Citizenship is another tragedy - His dad shows up on a tourist visa - applies for asylum while Future Terrorist is only 8 yrs old in 2002 - by 2007 he and his terrorist brother became permanent residents - but still went back to Russia to re-new his passport. By 2012, on 9/11 he took the oath to become a US Citizen — only to turn around and attack the US.

The kicker to this is - they could go back and see if his app for citizenship was fraudulent - any investigator could prove that — they had a plan - it comes down to who pulls the strings of financing this investigation - where his citizenship could be revoked and a military court seeks the death penalty from a foreign enemy attacking actual US CITIZENS.
..but I’ve not seen that play out — again, the Gov elitist trash citizens once again.
