Contested Flynn dismissal to go before full appeals court as legal saga drags on (En Banc hearing granted!)

The dispute over the Department of Justice's move to dismiss criminal charges against former Trump national security adviser Michael Flynn will get a rehearing by the entire District of Columbia Circuit Court of Appeals, the latest twist in the long-running legal drama that stemmed from the FBI's investigation into possible collusion between the Trump campaign and Russia in 2016.

The order was issued Thursday by the court. Called an "en banc" hearing, all 11 judges on the appeals court will sit in on a rehash of arguments that were made before a three-judge panel in June, which led to a 2-1 ruling in favor of Flynn.

People, correct me if I am wrong but did not a federal judge in Texas throw out the not guilty of murder verdicts on several Branch Davidians and then arbitrarily, and without the authority, sentence them to prison anyway? The federal judges have been out of control for a long, long, time.

More proof that the punishment is the process. The federal government has unlimited resources so dragging out proceedings and forcing a defendant to keep paying legal bills until he is destitute IS the punishment.

This case and several others ... the way our government rebelled against the election, and then our government covered it up ... the way our government is rejecting the will of the people .. those actions by the government also influence the election in November.

The problem doesn’t start with actual trials - the problem starts long before that because you can’t indict without first demonstrating to the courts that your case is winnable, and since it isn’t winnable, you can’t even indict.

People should keep this in mind before they trash the AG and others for failing to indict.

President Trump should not pardon Flynn at this point when Flynn is still trying to be exonerated. Only if Trump loses should he issue a pardon to Flynn.

Of course if Biden wins, Attorney General Stacey Abrams will try to find another charge to go after Flynn with.

The government isn’t a party, no matter what. This is court vs. defendant. The government’s stake in this is government power to withdraw a charge. as far as the court is concerned, it HAS allowed the charge to be withdrawn. What Sullivan is not releasing is the defendant, and he is doing so by abuse of judicial power.

I think you are saying the en banc appeals court should rule in favor of Flynn, and I agree. But how many of them are Obama/Bush/Clinton deep staters?
