Dick Heller is reportedly mulling another lawsuit against the District of Columbia, and once againits over the Second Amendment. Heller was the man who brought about the key DC v. Heller case that tossed the citys handgun ban and asserted an individual right for Americans to own firearms outside of service in a militia. Yet, it only applied to federal enclaves. In 2010, McDonald v. Chicago expanded that standard to the states. Theres no doubt the capital also faces differing circumstances, given the number of VIPs that reside in the area, like the president of the United States, but that doesnt excuse the months-long wait people have been subjected to regarding exercising their constitutional rights. These are law-abiding citizens. Its not right.

I love DC and Chicago: they never learn their lessons and they keep generating wonderful binding precedents at the Supreme Court. Other places like New York figured out that when you can’t possibly win, you have to back down to avoid a catastrophic loss. But not DC and Chicago! They just double down, lose badly in court, and then cut huge checks to Alan Gura. They’re the gifts that keep on giving!
Scotus could have made things clearer, but didn’t AND won’t with the current court makeup.
In the meanwhile, they’re able to thwart the 2nd Amendment rights of people for 5 years out of every 6. That’s a win for them. The checks are for money that’s not theirs, anyway.
But from Massachusetts came "Caetano v Massachusetts" in 2016...a state felony conviction that SCOTUS overturned:

That was a conviction that the Massachusetts Supreme Court had upheld,ruling that Caetano's 2nd Amendment rights were not infringed by the state.

Since Heller and McDonald were decided a decade ago, Roberts has become very squishy on the Second Amendment, and several potentially ground-shaking cases that would have greatly firmed up the Second Amendment and its scope of protections have been turned down due to Roberts’ reluctance to uphold prior Heller and McDonald rulings.
I’m not sure who I want to see replaced more on the Supreme Court; Ginsberg or Roberts.

Yeah, well I’m afraid that if Roberts leaves the court, Kavanaugh will assume the mantle of “swing vote.” I don’t trust the guy, and so far I can’t see why the Left fought his nomination so hard. Unless it was a Brier Rabbit moment.

According to our Constitution, the Supreme Court is tasked with adjudicating what is and is not "Constitutional."
If a bill is passed and signed into law, and upheld by SCOTUS, that I feel violates the Second Amendment, what I do next depends on whether I wish to become the next Ruby Ridge or Waco.
I also know that anything I do as an individual will be meaningless and will not change a thing. But I'll be dead comforted in the knowledge that I died a futile death being morally right.
Yes, and Caetano extended the established precedent for the Second Amendment beyond firearms. So thank you Massachusetts! Keep up the stubborn ignorance so SCOTUS can continue to expand the court-recognized scope of the Second Amendment!
I was actually a plaintiff (one of many) on a lawsuit against a locality in another state challenging a stun gun ban filed immediately after the Caetano decision. The local government yanked their ordinance just before we went to court. I don’t particularly care about stun guns, but that isn’t really the point. The tool of self defense you CHOOSE to employ is YOUR business; NOT the government’s!

There’s a right way and a wrong way to fight these battles, and your smugness looking down your nose at those less fortunate living in non-free states doesn’t solve anything.

Voting for the right candidates who will pass the right laws, and for the right President who will appoint the right Judges and Justices, and providing financial support to the right civil rights groups is working within the system.
