BELTON, S.C. (WSPA)- Belton mayor Tiffany Ownbey is pressing for a revenge porn law in South Carolina after she says she was a victim.
Years ago, Tiffany Ownbey was in a relationship with a man who used his cell phone to secretly record a private intimate encounter with her without her consent, according to Ownbeys attorney Druanne White. White said the man later revealed to Ownbey that he had the recording and threatened to distribute it if she broke up with him. Ownbey told him she would press charges.
I felt violated. I felt hurt, anger, Ownby said. Theres no words to describe how I felt at that point.
She said she never saw the recording.
Kind of forgot about it, Ownbey said. Didnt think anything.
Ownbey then went years without contact with that man, according to her attorney. After she became Beltons first elected female mayor in November, her lawyer said Ownbey began hearing rumors that the recording may be released. The recording has since been released.
Several weeks ago, Ownbey asked the South Carolina Law Enforcement Division to investigate. She said it wasnt a difficult decision to make.
Because I have a daughter, she said. If this happened to me, it could happen to anyone.
SLED is now investigating. The public reaction to the investigation isnt what the mayor expected.
I knew I was going to have some adverse publicity, but I never expected in a million years to be victim shamed the way I was, she said.
She said that felt like being violated all over again.
I guess I was kind of appalled. Like really? Were in 2020 and someone comes forward from being a victim and thats how you treat them? Thats whats wrong with whats going on today, she said.
According to the Cyber Civil Rights Initiative, South Carolina is one of four states that dosent have a law criminalizing the publication of non-consensual pornography, also known as revenge porn.
White said right now in South Carolina, its difficult to prosecute someone who records and releases intimate acts without consent.
A prosecutor must prove every element of the crime beyond a reasonable doubt, White said. So as a prosecutor youre trying to kind of squeeze some behavior over here into this law, but it dosent quite fit, youre going to have a really hard time.
Ownbey wants to change that. Shes pushing for South Carolina to make revenge porn a crime.
Revenge porn is real and its happening daily,she said. Its happening to a lot women. And its time something happens about it. If somebodys going to stand up, why not me?
White said a law should require people to get written permission to record a sexual act and then distribute it or face a felony.
Several bills that would criminalize revenge porn have been introduced in South Carolinas General Assembly, but none of them have ever been passed into law.
It was a sleeze ball thing to the guy to do....

NO. Naked pictures don't "end up" on someone else's phone. Any more than someone "ends up" pregnant. In order to have naked pictures on someone else's phone, they have to be taken. If they are taken without your consent, it is a crime (though the lack of prosecution is very telling about how often this really occurs). If they are taken with your consent, you are an idiot. Either way there is a direct cause and effect relationship to what happened. There is no "end up" in this equation.

Under the tradition I was raised under, the act of having sex was what created the marriage, not a license, oath, or priest. Having sex created one flesh. Having a multitude of partners meant being ripped to shreds.
Under that tradition, one was very careful with whom who they connected A to B and mixed well. The one flesh consequence was permanent.
I really doubt that.

When women have affairs they are liable to let their lover get away with stuff they wouldn’t even let their husbands get away with.

By “end up” I was referring to the practice where a lot of young people snap um, compromising pictures of each other with their phones during the course of a relationship. With each other’s consent. Because of course “they are in love”.
The point here is when I was young, the only people who had access to these miniature cameras were the CIA/KGB etc. And they cost tens of thousands of dollars. Today everyone has it.
